The National Assembly has just passed the Law amending and supplementing a number of articles of the Law on Vietnamese Workers going to work abroad under contract.
The Law amending and supplementing a number of articles of the Law on Vietnamese Workers going to work abroad includes 3 Articles, effective from March 1, 2027.
The law stipulates that priority is given to sending trained workers with technical expertise to work abroad under contract to improve income, train skills, access technology, modern management, foreign languages, labor discipline, and industrial style.
At the same time, strengthen job information connections for workers returning home with the domestic labor market to promote and effectively use skilled human resources who have worked abroad.
Vietnamese workers going to work abroad under contract in some industries, professions, jobs requiring technical expertise or fields that the State prioritizes for development are entitled to special mechanisms and policies to go to work abroad and attract and effectively use human resources after returning home in accordance with socio-economic conditions in each period according to the Government's regulations.
The law also requires businesses to commit in writing about the time to wait for exit after the employee is recruited. This time period must not exceed 180 days, calculated from the date the employee is recruited to work abroad.
If the commitment is not properly implemented, the enterprise must compensate according to the agreement and refund service fees and other amounts that the employee has paid, after deducting the spent portion. This regulation does not apply in cases of force majeure or other agreements between the two parties.
The Minister of Home Affairs is assigned to stipulate the time limit for enterprises to implement compensation and refund money to employees.
Businesses are responsible for managing and protecting the legitimate rights and interests of employees during their time working abroad.
At the same time, they are responsible for notifying competent authorities when incidents occur that affect their lives, health or rights.
Businesses must also advise and support employees to access legal aid services when needed.
