This is a notable content in the latest draft Circular regulating the leave regime for officers, professional soldiers, workers and defense officials that is being consulted by the Ministry of National Defense.
In particular, Article 10 of the draft Circular proposes the retirement pension regime as follows:
1. Soldiers, workers and defense officials who have decided to retire or are entitled to pre-retirement leave, if they have worked until the time of pre-retirement leave:
a) From 15 years of service to less than 20 years of leave of 6 months;
b) From 20 years of service to less than 25 years of leave for 9 months;
c) After 25 years of service or more, 12 months off is granted.
2. During the pre-retirement leave period prescribed above, soldiers, workers and national defense officials are paid and counted as time participating in social insurance.
3. Soldiers, workers and defense officials who wish to retire immediately (not retiring in preparation for retirement or not retiring for enough time as prescribed), when transferred, will receive a salary difference due to not retiring in preparation for retirement according to current regulations; except for those who are entitled to one-time allowance due to early retirement according to prescribed age.
4. During the retirement preparation period, if you are detected with serious illnesses, diseases requiring long-term treatment, or mental illness, follow the provisions of Circular No. 157/2013/TT-BQP dated August 26, 2013 of the Minister of National Defense regulating the management, treatment, care, and settlement of policies for soldiers, workers, defense officials, and people working in key organizations managed by the Army who are suffering from serious illnesses, diseases requiring long-term treatment, mental illnesses and guiding documents for implementation.
The draft Circular also clearly states that the authority to resolve retirement pensions prescribed in Article 10 of this Circular is implemented as follows:
a) For officers performing according to the Regulations on personnel work in the Vietnam People's Army of the Central Military Commission.
b) For professional soldiers, workers and defense officials, the provisions of the Minister of National Defense shall apply.
It is expected that Circulars No. 153/2017/TT-BQP of the Minister of National Defense regulating the leave regime for officers of the Vietnam People's Army and Circular No. 113/2016/TT-BQP of the Minister of National Defense regulating the leave regime for professional soldiers, workers and defense officials will expire from the effective date of this Circular.
The regulations in the draft Circular of the Ministry of National Defense on retirement preparation leave have many changes compared to current regulations.
Previously, according to Circular No. 153/2017/TT-BQP, officers are entitled to pre-retirement leave as follows:
a) From 20 years of service to less than 25 years of service, 9 months off is granted;
b) After 25 years of service or more, 12 months off is granted.
According to Circular No. 113/2016/TT-BQP, professional soldiers, workers and defense officials are entitled to take pre-retirement leave as follows:
a) From 20 years to less than 25 years of social insurance contributions, 09 months off is granted;
b) After 25 years of social insurance contributions or more, they will have 12 months off.
