The Presidential Office has announced the President's Order on laws passed by the 16th National Assembly, including the Basic Reconciliation Law. This Law takes effect from March 1, 2027.
This Law stipulates the principles and policies of the State on mediation at the grassroots level; mediators, mediation groups, people invited to participate in mediation, parties in mediation at the grassroots level; mediation activities at the grassroots level; responsibilities of agencies and organizations in mediation at the grassroots level.
The law does not apply to mediation activities of courts, arbitration, commercial mediation, labor mediation, mediation at commune, ward, special zone People's Committees and mediation activities stipulated by other laws.
Article 5 of the law stipulates information security in grassroots mediation.
Accordingly, mediators, parties, invited mediators, interpreters and other relevant agencies, organizations, and individuals are responsible for keeping state secrets, confidential information about private life, personal secrets, family secrets, business secrets of the parties and other information as prescribed by law, unless otherwise agreed or prescribed by law.
In the mediation process, only records are allowed to serve the mediation and the recorded content must be kept confidential, not recorded audio or video, unless the parties have an agreement or the law has other regulations.
According to the law, agencies, organizations, and individuals who violate regulations will be handled according to the provisions of law.
And in Article 6, the law also introduces many state policies on grassroots mediation.
In which, encouraging parties to resolve conflicts and disputes through mediation at the grassroots level. Encouraging people with prestige in families, clans, and residential communities; people with legal qualifications, professional knowledge, social knowledge; people who know the language and writing of ethnic minorities, sign languages, scripts specifically for people with disabilities and other prestigious people to participate in mediation at the grassroots level;
Promoting the core role of the Vietnam Fatherland Front and member organizations of the Front in grassroots mediation work.
Create conditions for grassroots mediation work to operate effectively; encourage organizations and individuals to contribute and support grassroots mediation work.
Encourage the application of information technology, digital transformation; equip technical means for mediation work at the grassroots level.
