At the first session, the 16th National Assembly passed the Law amending and supplementing a number of articles of the Law on Notarization. This Law takes effect from January 1, 2027.
This Law has amended and supplemented Article 66 on notary databases. Accordingly, the notary database includes the following data:
Information about notaries, notary practice organizations, notarized transactions; information on the transaction status of assets; information on measures to prevent and warn of risks in notarization activities; notarized documents and other documents in notarization dossiers.
The notarized database must be fully, accurately, promptly updated and ensure security and safety in accordance with the law.
The collection and provision of information to be put into notarized databases and the exploitation, use, and sharing of notarized databases must comply with the provisions of this Law and other relevant legal regulations on information security on notarized content, protection of privacy, personal secrets, and family secrets.
The connection and sharing of information between notary databases and national databases, databases of ministries, branches, localities and other databases must ensure efficiency, safety, and conformity with functions, tasks, and powers according to the provisions of this Law and other relevant legal regulations.
The notary database is managed centrally and decentralized management according to the state management responsibility for notarization of the Ministry of Justice and the Provincial People's Committee.
The Ministry of Justice is responsible for building a synchronous and unified notary database from central to local levels according to standards and technical regulations nationwide.
The Minister of Justice promulgates regulations on management, updating, exploiting, using, and sharing notarized databases nationwide.
The cost of building, managing, operating, maintaining, and upgrading the notary database is used from the state budget and other sources according to the provisions of law.
