Recently, information about the election of Village Heads and Heads of Residential Groups, especially during the time of streamlining the apparatus of the political system, has received much attention from readers.
According to the Ministry of Home Affairs, while waiting for competent authorities to issue documents to amend, supplement or replace Circular No. 04/2012 (amended and supplemented in Circular No. 14/2018 and Circular No. 05/2022), the process of electing Village Heads and Heads of Residential Groups shall comply with the provisions of Articles 6, 7, and 8, Decree No. 59/2023/ND-CP dated August 14, 2023 of the Government detailing a number of articles of the Law on Grassroots Democracy.
Accordingly, the Chairman of the People's Committee at the commune level is responsible for:
Promulgating the decision to organize the election of the village heads and the head of the residential group; Assume the prime responsibility for, and coordinate with the Standing Committee of the Vietnam Fatherland Front Committee of the commune, developing plans, professional guidance and organizing the implementation of the plan within 20 days before the meeting of the meeting of the community to elect village heads and heads of the residential group.
issue a decision to establish an Election Team no later than 10 days before the date of holding a community meeting to elect a Village Head or Residential Group Head after reaching an agreement with the Vietnam Fatherland Front Committee at the commune level.
The election team includes: Representatives of the Front Working Committee in villages and residential groups as the Team Leader; members are representatives of mass organizations, politics - society and representatives of households in villages and residential groups (not candidates for Village Heads and Residential Group Heads).
Decisions must be notified to the people in the villages, residential quarters, listed at cultural houses, community houses of the village, residential groups and notified on the radio system or in other forms suitable to the local conditions at the latest 7 days before the election.
Head of the Front Task Force in the village and residential groups held a meeting of the Front Task Force in the village and the residential group to expect the list of villagers, heads of the residential group; report to the Party Cell Party Committee and the residential group to agree to introduce at least one person to the village head and the head of the residential group; organize a meeting of the Front Task Force in the village and residential group after the opinions of the Party cell Party Committee and the residential group to decide the official list of candidates (at least 1 person).
The meeting content must be recorded in form No. 05 attached to this Decree and sent to the People's Committee at the commune level no later than 15 days before the meeting of the community.
The organization of the election of Village Heads and Heads of Residential Groups at community meetings shall comply with the provisions of Article 3 of this Decree.
Within 5 working days from the date of receiving the decision approved by the community, the Commune People's Committee shall consider and decide to recognize the election of the village head, the head of the residential group or the decision to re -elected; In case of not issuing a decision to recognize or re -elected decisions, it must be written in writing and stating the reason.
Village heads and residential group heads officially operate when there is a recognition decision from the commune-level People's Committee.
