Article k, Clause 2 of the Social Insurance Law (Amended) stipulates that one of the mandatory social insurance participants is a non-professional civil servant at the commune, village, or neighborhood level.
In contrast, the current Social Insurance Law does not stipulate that a non-professional civil servant at the village or neighborhood level is a mandatory social insurance participant, but only a non-professional civil servant at the commune level participates in mandatory social insurance.
In contrast, Clause 6, Article 33 of Decree 33/2023/ND-CP, a non-professional civil servant at the village or neighborhood level with no more than three positions (including the Secretary of the Party Committee, Village Chief, or Neighborhood Committee Chairman, Village Front Committee Chairman) is entitled to a monthly allowance.
In the event that the Law stipulates otherwise, the provisions of that law shall be implemented. It is encouraged to have the Secretary of the Party Committee concurrently serve as Village Chief, Neighborhood Committee Chairman, or Village Front Committee Chairman. These individuals are entitled to a monthly allowance in accordance with the provisions of the law.
Therefore, from July 1, 2025, when the Social Insurance Law (Amended) takes effect, the Village Front Committee Chairman will be a mandatory social insurance participant.
