According to the program of the 8th Session of the 15th National Assembly, this afternoon (October 28), the National Assembly listened to the Presentation and Report on the Draft Law on amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army (VPA) and discussed in groups the Draft Law on amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army.
According to the National Assembly's Working Program, from 3:30 p.m. this afternoon, General Phan Van Giang - Politburo member, Deputy Secretary of the Central Military Commission, Minister of National Defence - authorized by the Prime Minister, presented the Report on the draft Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army.
Next, the Chairman of the National Assembly's Defense and Security Committee presented the Report on the examination of the draft Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army.
After that, the National Assembly will discuss in groups the draft Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army.
In the draft law submitted to the National Assembly, the Government proposed raising the service age of majors from 48 to 52, lieutenant colonels from 51 to 54, lieutenant colonels from 54 to 56, and colonels from 57 for men and 55 for women to 58. The service age of generals remains the same at 60 for men, while that of women increases from 55 to 60.
According to the draft law, when the military has a need, officers with sufficient political and moral qualities, good professional skills, good health and who volunteer can have their service age extended for no more than 5 years.
The retirement age of reserve officers is also proposed to increase. The age of reserve officers will increase from 51 to 53, majors from 53 to 55, lieutenant colonels from 56 to 57, lieutenant colonels from 57 to 59, and colonels from 60 to 61. The general rank will remain at 63. For the commander of the commune-level military command, the maximum service age will be implemented according to the provisions of the Labor Code.
Previously, responding to the petition of voters of Thai Binh, Ha Tinh, and Ha Nam provinces transferred by the Petition Committee under Official Dispatch No. 655/BDN dated August 2, 2024 on studying and submitting to the National Assembly for consideration of amending and supplementing the Law on Officers of the Vietnam People's Army to resolve outstanding issues and shortcomings, the Ministry of National Defence stated:
Based on the results of the summary of the implementation of the Officer Law, the Ministry of National Defence has prepared a draft Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army, proposing that the Government submit it to the National Assembly for consideration and approval at the 8th Session (October 2024).
In particular, the draft law has amended and supplemented the basic positions of officers, increased the age limit for active service of officers from 1 to 5 years so that officers (Major, Lieutenant colonel) upon retirement will basically receive the maximum salary according to the provisions of the Law on Social Insurance; overcome difficulties and inadequacies in practice regarding regimes and policies (such as housing policies) for officers, ensuring feasibility, conformity with the legal system and the nature and tasks of the Army "as a special labor sector".
