On September 23, the National Assembly Standing Committee gave opinions on the draft Law amending and supplementing a number of articles of the Law on Occupational Safety and Health.
According to Member of the Party Central Committee, Minister of Home Affairs Nguyen Tien Hai, the development of the Law amending and supplementing a number of articles of the Law on Occupational Safety and Health aims to promptly handle truly necessary and urgent issues arising from the arrangement of the state apparatus and local government organization at 2 levels.
At the same time, handle directly related contents to ensure the consistency, synchronization and feasibility of laws on occupational safety and health.
The draft amended Law stipulates the declaration, investigation and statistics, reporting of occupational accidents to be consistent with the 2-level local government model.
The draft law also amends the state management responsibility for occupational safety and health to be consistent with the requirements of assignment and decentralization in state management and the current organizational structure.
The draft Law cuts 1 conditional business line for occupational safety and health training services; cuts 4 administrative procedures for issuing Certificates of eligibility for occupational safety and health training activities.
Regarding the content of decentralization and decentralization, there are 2 specific groups as follows:
Legalizing the provisions of Decree 129/2025/ND-CP of the Government stipulating the demarcation of the authority of local authorities at 2 levels in the field of state management of the Ministry of Home Affairs; transferring 1 task from the district-level police agency to the commune-level police for "receiving declarations for accidents causing death or serious injury from two or more workers".
Legalizing the regulations in the decree, transferring 1 task "receiving statistical content, reporting on labor accidents, technical incidents causing serious unsafety and labor unsanitary conditions related to workers working without labor contracts" from the District-level People's Committee to specialized agencies under the Provincial-level People's Committee.
Preliminary appraisal, the Standing Committee of the National Assembly's Committee for Culture and Society basically agreed with the amended and supplemented contents of the draft Law and proposed to pay attention to some issues.
Including issues of declaration and investigation of labor accidents, technical incidents causing unsafety and labor unsanitary conditions, and technical incidents causing serious unsafety and labor unsanitary conditions.
The Committee for Culture and Social Affairs proposes to review the mechanism for declaration, receipt, and processing of information in accordance with the functions of the commune-level police in order to promote the role of receiving and directly handling fatal and seriously injured accidents; consider regulations on declaration deadlines.
At the same time, review in the direction that the Law stipulates principles, requirements, authority, and responsibilities; assign the Government to detail the order, method of declaration and organize investigation, ensuring flexibility, timeliness, and feasibility.
