Article 60 of the 2024 Land Law (amended) stipulates the principles for making land use planning and plans as follows:
1. Land use planning at all levels must comply with the principles and relationships between types of planning as prescribed by the Law on Planning.
Land use planning at all levels must synthesize and balance land use needs of sectors and fields that use land.
2. National land use planning must ensure specificity and regional connectivity; ensure balance between land use needs of sectors, fields, and localities and be consistent with the country's land potential in order to use land economically and effectively.
3. Land use planning and plans established at national, provincial and district levels must meet the requirements of implementing the strategy for rapid and sustainable socio-economic development; ensuring national defense and security.
4. Ensure consistency and synchronization; land use planning of the higher level ensures land use needs of the lower level; land use planning of the lower level must be consistent with land use planning of the higher level; district-level land use planning must determine land use content up to the commune level; land use plans must be consistent with land use planning of the same level that has been decided and approved by competent authorities.
5. Land use planning content must combine land use indicators with space, land use zoning, and natural ecosystems.
6. Use land economically and effectively; exploit natural resources rationally and protect the environment; adapt to climate change; ensure national food security and forest coverage; preserve, restore and promote the value of historical and cultural relics and scenic spots.
7. Ensure continuity, inheritance, stability, specificity, and connectivity of socio-economic regions; harmonious balance between sectors, fields, localities, and generations; consistent with land conditions and potentials.
8. The preparation of land use plans at all levels must ensure the participation of socio-political organizations, communities, and individuals; and ensure publicity and transparency.
9. Land use planning at all levels is prepared simultaneously; higher-level land use planning must be decided and approved before lower-level land use planning. When the land use planning period ends and the land use planning for the next period has not been decided and approved by the competent authority, the unfulfilled land use targets shall continue to be implemented until the land use planning for the next period is decided and approved by the competent state agency.
10. Land use plans are prepared at the same time as the preparation and adjustment of land use plans at the same level. The first year land use plan of a district-level land use plan is prepared at the same time as the preparation of a district-level land use plan.
Thus, land use planning and planning is carried out according to the above principles.
