Article 59 of the Housing Law 2023, effective from August 2024, stipulates the cases in which apartment buildings must be demolished as follows:
1. Apartment buildings that must be demolished according to the provisions of Clause 2 of this Article include:
a) Apartment buildings that have expired their usage period as stipulated in Article 58 of this Law and must be demolished;
b) Apartment buildings that have not yet expired their usage period as stipulated in Article 58 of this Law but must be demolished.
2. Cases in which apartment buildings must be demolished include:
a) Apartment buildings damaged by fire or explosion, no longer ensuring safety for continued use;
b) Apartment buildings damaged by natural disasters or enemy sabotage, no longer ensuring safety for continued use;
c) Apartment buildings with main structural elements showing overall dangerous conditions, at risk of collapse, not meeting conditions for continued use, requiring urgent relocation of owners and users;
d) Apartment buildings severely damaged, showing localized dangerous conditions in main structural elements and having one of the following factors: fire prevention and fighting technical infrastructure; water supply, drainage, wastewater treatment; electricity supply, internal traffic not meeting current technical standards or posing operational safety risks, requiring demolition to ensure safety for owners and users and urban renovation and embellishment requirements;
đ) Apartment buildings damaged in one of the following main structural elements: foundation, columns, walls, beams, trusses not meeting normal usage requirements but not yet subject to demolition as stipulated in points c and d of this clause, but located in areas requiring synchronized renovation and construction with apartment buildings subject to demolition as stipulated in this clause according to approved construction planning.
Thus, from August 2024, apartment buildings subject to demolition are regulated as above.
