How to deal with the death of a sperm or embryoender

The Lao Dong Newspaper Legal Consulting Office replied:

Clause 2, Article 9 of Decree 207/2025/ND-CP (effective from October 1, 2025) stipulates the case of sperm sending, amenorrhea sending, or dead embryos:

a) If the sperm lover dies, the storage facility must destroy the sperm he/she is holding, except in the following cases: the wife wishes to give birth with the sperm of the deceased husband; or before death, send a document expressing her wish to donate sperm to the storage facility as prescribed in this Decree;

b) If the person submitting the deferral dies, the storage facility must cancel the deferred number held by that person, except in cases where before death, a document expressing the wish to donate the deferral is sent to the storage facility as prescribed in this Decree;

c) If the husband in the couple sends an embryo to death, the couple's embryos must be destroyed, except in the following cases: the wife wishes to give birth by embryos of the couple; or the wife has a document donating the embryos to a storage facility for scientific research or performing assisted reproductive techniques for a single woman or another couple;

d) If the wife in the couple or both husband and wife submit the embryo to death, the embryos of that couple must be destroyed, except in cases where there is a document from both husband and wife expressing their wish to donate the embryos to a storage facility for scientific research or to perform assisted reproductive techniques for a single woman or another couple;

dd) If a single woman submits an individual to a storage facility for scientific research, the individual's embryos must be destroyed, unless there is a document expressing her wish to donate the embryos to a storage facility for scientific research before death.

Thus, from October 1, 2025, when the sperm and embryo recipient dies, the above regulations will be followed.
