People receiving social pension benefits who have died will be supported with funeral expenses

The Lao Dong Newspaper Legal Consulting Office replied:

Article 5, Decree 176/2025/ND-CP stipulates support for funeral expenses as follows:

1. Subjects receiving social pension benefits or those who have submitted a written request to receive social pension benefits and are eligible for them but the Chairman of the People's Committee at the commune level has not issued a decision to receive social pension benefits upon death will be supported for funeral expenses according to the level prescribed in Clause 2, Article 11 of Decree No. 20/2021/ND-CP dated March 15, 2021 of the Government regulating social assistance policies for social protection beneficiaries.

2. In case the subjects specified in Clause 1 of this Article are supported with funeral and burial costs specified in many different documents with different levels, they will only receive the highest level.

3. Sequence of implementation of funeral cost support

a) Organizations and individuals who bury subjects with a Declaration of Proposal for Support for funeral costs according to Form No. 02 issued with this Decree shall send directly or via a post office organization or online to the Chairman of the People's Committee at the commune level;

b) Within 03 working days from the date of receipt of the complete dossier, the Chairman of the People's Committee at the commune level shall consider and decide to support the funeral cost.

Thus, a person receiving social pension benefits who dies will be supported with funeral expenses according to the above regulations.
