Regulations on social pension benefits payment

The Lao Dong Newspaper Legal Consulting Office replied:

Clause 2, Article 6, Decree 176/2025/ND-CP stipulates the payment of social pension benefits as follows:

a) Social pension benefits are paid in full and promptly monthly, to the right beneficiaries;

b) The selection of a social pension payment service organization is carried out in accordance with the provisions of law. Organize payment implementation to ensure the requirement of having experience in paying social security policies, having a network of transaction points in communes, wards, and special zones; being able to make payments at home to some specific subjects; ensuring conditions for timely and safe payment; having human resources to support the People's Committees at the commune level in updating the database, monitoring changes in subjects in the community;

c) Payment through a payment service organization is made in a contract between the People's Committee at the commune level and the payment service organization. The contract clearly states the scope, payment subject, payment method (including payment method via bank account, electronic payment account as prescribed by law or direct payment in cash), payment time, payment cost, payment period, rights and responsibilities of the parties, and other agreements related to payment;

d) Before the 25th of each month, the People's Committee at the commune level shall base on the list of beneficiaries in the area; the amount of funds paid in the following month (including the collection and burial fees of the subject); the remaining funds not paid in the previous months (if any) shall be withdrawn from the State Treasury and transferred to the deposit account of the payment service organization, and at the same time transfer the payment list to organize payment services for the beneficiary in the following month. During the payment period, the People's Committee at the commune level shall send a person to supervise the payment of the payment organization;

d) Every month, the payment service organization compiles and reports the list of subjects who have received money and the amount of money paid; the list of subjects who have not received money to transfer to pay in the following month, the remaining unpaid funds and transfers the documents (list of signed documents, bank transfer documents) to the People's Committee at the commune level before the 20th of each month to summarize the settlement of payment costs according to regulations.

Thus, the payment of social pension benefits is regulated as above.
