Office of Legal Consulting Lao Dong Newspaper replied:
Article 34 of the 2023 Law on Identification (effective from July 1, 2024) stipulates the locking and unlocking of electronic identification cards as follows:
1. Electronic ID is locked in the following cases:
a) When the person granted the electronic ID card requests a lock;
b) When the person granted an electronic identification card violates the agreement on using the national identification application;
c) When the person granted an electronic ID card has his/her ID card revoked or held;
d) When the person granted the electronic identity card dies;
d) Upon request of the prosecution agency or other competent authority.
2. Electronic ID is unlocked in the following cases:
a) When the person granted an electronic identification card as prescribed in Point a, Clause 1 of this Article requests unlocking;
b) When the person granted an electronic identification card as prescribed in Point b, Clause 1 of this Article has corrected the violations of the agreement on using the national identification application;
c) When the person granted an electronic identification card as prescribed in Point c, Clause 1 of this Article has the identification card returned;
d) When the prosecution agency or other competent authority specified in Point d, Clause 1 of this Article requests unlocking.
3. When locking an electronic identification card in the cases specified in Points a, b, c and d, Clause 1 of this Article, the identification management agency must immediately notify the person whose electronic identification card is locked.
4. The head of the identification management agency of the Ministry of Public Security has the authority to lock and unlock electronic identification cards.
5. The Government shall prescribe the procedures for locking and unlocking electronic identification cards.
Thus, locking and unlocking electronic ID cards is regulated as above.
