Storms and floods are forms of natural disasters as prescribed by current law.
Article 12 of Decree 81/2021/ND-CP stipulates tuition fees as follows:
1. Tuition fees are collected periodically every month; if the student volunteers, the school can collect them once for the entire semester or the entire school year. For continuing education institutions, continuing training and short-term training and development courses, tuition fees are collected based on the actual number of months of study. For preschool and general education institutions, tuition fees are collected for a maximum of 9 months/year. For higher education and vocational education institutions, tuition fees are collected for a maximum of 10 months/year.
2. In case of natural disasters, epidemics, or force majeure events, tuition fees will be collected based on the actual number of months of study (including the time for organizing online teaching or arranging make-up time at school); tuition fees will not be collected during the time when teaching is not organized. The tuition fee collection level ensures the principle of the actual number of months of study and the necessary expenses incurred to organize teaching but does not exceed the total tuition fee collection calculated according to the maximum number of months of 01 school year (maximum 9 months/year for preschool and general education institutions and maximum 10 months/year for higher education institutions and vocational education institutions) and is made public from the beginning of the school year in educational institutions. The provincial People's Committee submits to the People's Council for specific decisions on the collection time and tuition fee levels for public preschool and general education in the area; Heads of higher education institutions and vocational education institutions shall prescribe the collection time and tuition fees in case of natural disasters, epidemics, and force majeure events.
3. In the case of organizing teaching and learning according to the credit system, educational institutions can convert to collect tuition fees according to credits, however, the total tuition fees collected according to credits for the entire course must not exceed the tuition fees prescribed for the course if collected according to the school year.
4. Educational institutions are responsible for collecting tuition fees and depositing them into commercial banks or the State Treasury for management and use. In case of cash tuition fees, the unit must periodically transfer (deposit) all remaining cash tuition fees collected in the fund to the unit's account at the State Treasury or a commercial bank for management according to regulations.
Thus, when natural disasters (storms, floods), epidemics, or force majeure events occur, tuition fees will be collected based on the actual number of months of study (including the time spent organizing online teaching or arranging make-up time at school).
