Clause 9, Article 26 of Decree No. 267/2026/ND-CP detailing the application of disciplinary measures and compensation for damages for acts causing waste and violations in organizing the implementation of waste prevention and control (effective from July 1, 2026) stipulates the temporary suspension of compensation implementation as follows:
a) The person who is obliged to make compensation is temporarily suspended from making compensation in the following cases:
Currently being treated at hospitals, women during maternity leave;
Families belonging to poor households, near-poor households according to the Government's regulations, families in difficult circumstances certified by the People's Committee of the commune where they reside;
Currently being temporarily detained and in custody pending the conclusion of competent authorities to investigate, verify and conclude on other violations of the law.
b) The time of temporary suspension of compensation is as follows:
Maximum no more than 6 months for cases being treated at hospitals, except for cases of serious illnesses, serious illnesses on the list issued by the Ministry of Health, the temporary suspension time corresponds to the actual treatment time; families belonging to poor households, near-poor households according to the Government's regulations, families in difficult circumstances certified by the commune-level People's Committee where they reside;
Maximum not exceeding the prescribed maternity leave period for women during maternity leave;
Maximum equal to the time of temporary detention, temporary custody for cases that are being temporarily detained, temporarily detained waiting for the conclusion of competent authorities investigating, verifying and concluding on other violations of the law.
Thus, from July 1, 2026, officials, civil servants, and public employees who cause waste may be temporarily suspended from compensation for damages in cases specified above.
