Singer rich, musician still poor
The issue of music copyright has just been heated up at a workshop on the impact of a number of legal policies in the field of performing arts organized by the Vietnam Center for Music Authorities Protection (VCPMC), Executive Committee of the Former National Assembly Club.
Musician Dinh Trung Can, who replaced musician Pho Duc Phuong as manager of the Vietnam Music Authorities Center, shared about the current status of music copyright.
He said that sadly, the obligation to exercise musical copyright has not been voluntarily, humanely, and fairly implemented. While singers sing a night and earn tens of thousands of dollars, 300 to 500 million in salary, and a rich life with houses and cars, when the musician calls to ask for royalties, he curses.
According to him, the singer only enriches show organizers. Organize a music night that sells tens of millions of a pair of tickets. The reality that has not changed for a long time is that singers are rich, show organizers are rich but musicians are still poor.
And the copyright fee for musicians is sweat, tears and is the legitimate currency for artistic talents. According to musician Dinh Trung Can, paying for tac pham should have been voluntary and responsible, on time.
According to VCPMC representative, the implementation of copyright obligations of many singers and artists today unintentionally causes difficulties in protecting music copyright, affecting Vietnam's commitment to the international community.
The law has allowed it, but the hearts of users of the works make it difficult for the center to complete its tasks, musician Dinh Trung Can emphasized.
The procedures for granting a program license cannot be without agreement between the musician and the organizer
The Director of the Vietnam Music Copyright Center said that, if you want to apply for a license for art programs and performances, the organizers will have to apply for permission from the authors first. Licensing dossiers need a contract or written agreement with the author or copyright owner. Yet, when collecting royalties is difficult, let alone abolishing, the implementation is even more difficult.
Mr. Dinh Trung Can cited VCPMC as taking out the rights to the music to give to a musician in advance because he needed money to treat cancer. Along with that, according to him, there are countless consequences if copyright for the author is not protected.
VCPMC representative also mentioned big shows using many songs by authors such as Trinh Cong Son, Phu Quang,.... Many big artists were also mentioned for not fulfilling their copyright obligations....
Previously, the Ministry of Culture, Sports and Tourism (MOCST) issued a decision approving the proposed plan to reduce and simplify investment and business conditions under the state management of the Ministry of Culture, Sports and Tourism (MOCST) as a basis for drafting a new Decree on performing arts activities to replace the previous decree.
In the new plan, the Ministry of Culture, Sports and Tourism proposes a plan to reduce the condition of "contract or document of agreement with the author or copyright owner" in the procedures for granting an performance license and a license to approve the content of recording and recording music and dance, stage (in Articles 9 and 24 of Decree No. 79/2012/ND-CP, amended and supplemented in Decree No. 15/2016/ND-CP).
