Coordinate handling violations to protect workers' rights
Faced with the situation that some businesses are late in paying and evading social insurance, health insurance, and unemployment insurance for a long time, directly affecting the rights of employees, the social insurance agency strengthens review, inspection, and urging the recovery of the amount to be paid, and at the same time coordinates with competent agencies to handle violations.
The case of MD Company in Ung Thien commune, Hanoi is a case handled according to this coordination mechanism. The company currently declares and pays social insurance for 5 employees but there is a situation of prolonged late payment and evasion, affecting the rights of employees. After Ung Hoa grassroots social insurance transferred violation information and the People's Procuracy of Region 12 - Hanoi participated in working, the Company has partially remedied the late payment amount in May and June 2026. As of August 2026, the amount the Company still has to pay according to the dossier is 158 million VND.
Ung Hoa Grassroots Social Insurance, as a person with related rights and obligations, has proposed to the People's Procuracy of Region 12 to exercise the right to initiate civil and public interest lawsuits according to Resolution No. 205/2025/QH15. The People's Procuracy of Region 12, in its role as the plaintiff, has initiated a lawsuit, requesting the Court to force MD Company to fulfill the obligation to pay social insurance money. The People's Court of Region 12 - Hanoi has accepted the case and decided to bring the case to trial on September 7, 2026 according to Decision No. 164/2026/QDXXST-DS dated August 27, 2026.
The case shows that the social insurance agency is more proactive in detecting violations, urging rectification, providing information and coordinating with the People's Procuracy to handle cases of late payment and evasion of payment according to legal regulations. The application of the mechanism of civil and public interest lawsuits contributes to strengthening violation handling, enhancing legal compliance and ensuring the rights of workers.
Strengthen inspection and handling of violations to ensure the rights of workers
As of the end of August 2026, the entire Vietnam Social Insurance system has issued inspection decisions at 6,694 units, including 5,920 labor-using units, 421 health insurance medical examination and treatment facilities, 188 units under the social insurance system and 165 organizations supporting the development of beneficiaries and payment of regimes.
The Social Insurance Agency has requested to recover more than 70.2 billion VND for 11,417 workers who have not participated or paid insufficiently for the time; more than 128.2 billion VND for 40,146 workers who paid insufficiently; recovered more than 330 billion VND in late payment and evasion of payment. The Social Insurance Agency has also issued or advised competent authorities to issue 362 decisions on administrative violations, with a total amount of more than 3.1 billion VND.
In the field of settling regimes, through inspection, the social insurance agency requested to recover to the social insurance fund more than 9.1 billion VND from 8,923 turns of workers enjoying regimes in violation of regulations; recover to the unemployment insurance fund 600 million VND from 106 turns of workers and recover to the health insurance fund more than 161.8 billion VND due to insufficient conditions for health insurance payment.
Along with inspection work, Vietnam Social Security continues to proactively and actively advise on building a legal corridor for handling violations in the fields of social insurance, unemployment insurance, and health insurance. Implementing the assignment of the leaders of the Ministry of Finance, Vietnam Social Security has participated in giving opinions in the process of drafting Decree No. 90/2026/ND-CP dated March 30, 2026 and Decree No. 283/2026/ND-CP dated July 15, 2026 of the Government, focusing on regulations on late payment and evasion of payment; penalty levels; remedial measures and sanctioning authority of social insurance agencies.
Right from the first months of 2026, Vietnam Social Security has also directed social security agencies in provinces and cities to strengthen inspection and handling of violations, especially for units that are late in paying or evading social insurance, health insurance, and unemployment insurance; not to prolong the situation of completing the urging step according to Decree No. 274/2025/ND-CP but not being inspected and handled. At the same time, it is required to monitor, urge and force the inspected units to fully remedy the detected violations.
In the coming time, Vietnam Social Security said that it will continue to strengthen propaganda, review, and urge the payment of social insurance, unemployment insurance, and health insurance; focus on inspecting units with signs of violations based on data analysis and risk assessment. At the same time, coordinate with the Police, Inspectorate, Procuracy, Labor Federation and relevant agencies to handle cases of late payment and prolonged evasion of payment, ensuring the rights of workers.
