Sending a question to the Ministry of Home Affairs, reader H.T.H said: "I am a civil servant recruited (with a recruitment decision from the Provincial People's Committee) to work at the Provincial Dong Nam Association, a mass association assigned by the Party and the State. May I ask, am I entitled to a public service allowance? ".
Regarding this issue, the Ministry of Home Affairs responds as follows:
Point a, Clause 2, Article 40 of Decree No. 126/2024/ND-CP dated October 8, 2024 of the Government on the organization, operation and management of associations stipulates: "People of working age are assigned or transferred by competent authorities to work at associations according to the decision of competent authorities and those recruited within the association's staffing quota according to the provisions of law on cadres and civil servants".
Point a, Clause 1, Article 77 of Decree No. 138/2020/ND-CP dated November 27, 2020 of the Government on recruitment, use and management of civil servants stipulates: "recruitment, use and management of those working in socio-political organizations - occupations, social organizations, social organizations - occupations operating nationwide, according to the staffing quota assigned by competent authorities shall apply the provisions of this Decree".
Clause 3, Article 39 of Decree No. 126/2024/ND-CP stipulates: "For associations assigned by the Party and the State in localities, based on the content of funding support in Clause 1 and Clause 2 of this Article, the People's Committees of provinces and centrally run cities shall provide funding support from local budgets according to the provisions of law".
Point a, Clause 3, Article 40 of Decree No. 126/2024/ND-CP stipulates: "People of working age who have a decision from the competent authority assigning or transferring them to work at the association and those who are recruited within the staffing quota assigned by the competent authority to the association will enjoy the policies according to regulations for cadres and civil servants and will enjoy the retirement regime according to the provisions of law".
People working at the association within the staffing quota that meets the above regulations are entitled to public service allowances according to regulations.
