Sending a question to the Ministry of Health, reader P.L said: "I would like to ask, are people who are 75 years old and are enjoying preferential treatment for people with meritorious services according to the Ordinance on Preferential Treatment for People with Meritorious Services to the Revolution entitled to social pension benefits?".
Regarding this issue, the Ministry of Health answers as follows:
Article 2 of Decree No. 176/2025/ND-CP dated June 30, 2025 of the Government detailing and guiding the implementation of a number of articles of the Law on Social Insurance on social pension allowances stipulates:
Article 2. Subjects and conditions for enjoying social pension benefits
Subjects and conditions for enjoying social pension benefits according to the provisions of Article 21 of the Law on Social Insurance, specifically as follows:
1. Vietnamese citizens are entitled to social pension benefits when they meet the following conditions:
a) From 75 years old or older;
b) Not receiving pension or monthly social insurance allowance; or currently receiving pension or monthly social insurance allowance lower than the pension allowance level specified in this Decree;
c) Having a written request to receive social pension benefits.
2. Vietnamese citizens from 70 years old to under 75 years old belonging to poor households, near-poor households according to the Government's regulations and meeting the conditions specified in points b and c, clause 1 of this Article".
Thus, citizens who are 75 years old and eligible to enjoy according to the provisions of Article 2 of Decree No. 176/2025/ND-CP and are enjoying preferential regimes for people with meritorious services according to the Ordinance on Preferential treatment for people with meritorious services to the revolution are still eligible for social pension benefits.
