On May 30, according to PV's investigation, Cao Bang Provincial People's Committee has just issued decisions to recover land for two businesses in the area after these units voluntarily returned land due to no longer needing to use it. The total area of land to be recovered is more than 326m2.
The decisions were all issued in May 2026, land recovery is carried out according to the provisions of the 2024 Land Law for cases where land users no longer need to use land and voluntarily return land to the State.
Specifically, in Decision No. 937/QD-UBND, the Provincial People's Committee decided to recover 191.3m2 of land in Thuc Phan ward that had been leased to Urban Development and Investment Construction Joint Stock Company to build the company's headquarters.
This land area was previously leased by the State according to land law regulations.
After the enterprise applied to return the land and was appraised by functional agencies, the Provincial People's Committee issued a decision to recover it for management according to regulations.
The entire area of land after recovery is assigned to the Cao Bang Provincial Land Fund Development Center for receipt, management and exploitation.
This unit is responsible for carrying out procedures related to land fund management, and at the same time advising on appropriate use plans in the coming time.
In addition, Cao Bang Provincial People's Committee also issued a decision to recover 134.8m2 of land leased to Cao Bang Agricultural Materials Joint Stock Company to implement the Hoa An Agricultural Materials Store project in Hoa An commune.
Unlike the case in Thuc Phan ward, the land area after being recovered from Cao Bang Agricultural Materials Joint Stock Company is assigned to Hoa An Commune People's Committee for direct management.
Local authorities are responsible for receiving and protecting the current status of the land area and developing land use plans to ensure compliance with planning and purposes in accordance with the law.
According to the content of the decisions, land recovery is carried out based on Clause 2, Article 82 of the 2024 Land Law.
This regulation allows the State to recover land in cases where land users no longer need to use it and have a document voluntarily returning the land.
