Citizens send questions to the Ministry of Agriculture and Environment with the content:
- Article 19 of Decree No. 88/2024/ND-CP stipulates:
“1. Households and individuals currently using agricultural land who are eligible for land compensation are supported to stabilize their lives as follows:
a) Recovering from 30% to 70% of the agricultural land area being used shall be supported within 6 months if not having to relocate and within 12 months if having to relocate; in case of having to relocate to areas with difficult socio-economic conditions or particularly difficult socio-economic conditions, the maximum support period is 24 months.
For cases of recovering over 70% of the agricultural land area being used, support is provided within 12 months if no relocation is required and within 24 months if relocation is required; in cases where relocation is required to areas with difficult socio-economic conditions or particularly difficult socio-economic conditions, the maximum support period is 36 months;
b) The area of agricultural land recovered to calculate support for stabilizing life specified in point a of this clause is the area within the scope of communes, wards, and towns where land is recovered at the time of the decision approving the compensation, support, and resettlement plan and is determined according to each project that must be recovered land by the competent People's Committee, not adding up the area of agricultural land recovered from previous land recovery projects;
c) The support level for one person specified in points a and b of this clause is calculated in cash equivalent to 30kg of rice/month according to the average price at the time of local support".
Thus, are the beneficiaries of support according to the above regulations households or individuals directly engaged in agricultural production?
- Clause 2, Article 22 of Decree No. 88/2024/ND-CP stipulates:
“2. Households directly engaged in agricultural production are supported in training, vocational conversion and job search as stipulated in point a, clause 1, Article 109 of the Land Law, which are households currently using agricultural land with at least one member having income from agricultural production on that land (including members arising after the time of agricultural land use) at the time of approval of the compensation, support, and resettlement plan and not falling into the cases specified in points a, b, c and d, clause 1 of this Article”.
So, in the case of a household with 4 members, including 3 members directly engaged in agricultural production and 1 member who is a cadre or civil servant, is this household entitled to the above support policy for all 4 members or only for 3 members directly engaged in agricultural production?
The Department of Land Administration (Ministry of Agriculture and Environment) exchanged as follows:
- Article 19 of Decree No. 88/2024/ND-CP dated July 15, 2024 of the Government stipulating compensation, support, and resettlement when the State recovers land has stipulated that households and individuals currently using agricultural land, if they are eligible for land compensation, are supported to stabilize their lives.
- Clause 2, Article 22 of Decree No. 88/2024/ND-CP stipulates:
“2. Households directly engaged in agricultural production that are supported in training, vocational conversion and job search as prescribed in point a, clause 1, Article 109 of the Land Law are households currently using agricultural land with at least one member having income from agricultural production on that land (including members arising after the time of agricultural land use) at the time of approval of the compensation, support, and resettlement plan and not falling into the cases specified in points a, b, c and d, clause 1 of this Article”.
Thus, Clause 2, Article 22 of Decree No. 88/2025/ND-CP has stipulated the conditions for households to be supported in training and vocational conversion.
