The Department of Home Affairs of Lang Son province has just sent a document to departments, branches, sectors and People's Committees of communes and wards in the area, guiding the implementation of Decree No. 173/2025/ND-CP dated June 30, 2025 of the Government on contracts for performing duties of civil servants.
The Department of Home Affairs clearly states three groups of authority to sign contracts:
In case of Clause 1 and Clause 3, Article 4 of Decree 173: The Department of Home Affairs appraises the dossier, submits it to the Chairman of the Provincial People's Committee for consideration and decision.
In case of Clause 2, Article 4: Heads of departments, branches or Chairmen of commune-level People's Committees must seek approval from the Chairman of the Provincial People's Committee (through the Department of Home Affairs) before signing the contract.
Professional work, internal support when human resources do not meet: Heads of agencies, units, Chairmen of People's Committees at the commune level can decide to sign contracts to serve work requirements.
The contract signing documents must be complete, including a contract signing plan clearly defining the industry, field, work content, funding source; preliminary resume, health certificate, copy of certificate, documents proving work experience.
Notably, Decree 173 strictly stipulates the standards and conditions for signing.
Not signing a contract with:
People who are cadres, civil servants, public employees, armed forces;
People banned from practicing, prosecuted for criminal liability or serving a sentence;
People with direct family connections or blood relatives with competent people signing contracts.
Contracts shall not be applied to regular state management tasks, tasks that easily arise conflicts of interest, or tasks related to national defense, security, and state secrets if there is no consensus between the Ministry of Public Security and the Ministry of National Defense.
The maximum contract term is 24 months, without signing an indefinite-term contract.
The signer of the contract is not included in the assigned payroll.
The agency or unit signing the contract must be responsible for ensuring compliance with the provisions of Article 9 of Decree 173.
The Department of Home Affairs emphasized that during the implementation process, if any problems arise, agencies and units need to promptly contact to agree on a solution.
