Mr. Nguyen Van Lai in Phu Tho said that he used to be the commune chairman, retired many years ago and is currently receiving a monthly allowance of about 3.6 million VND.
He heard information that social allowances will be adjusted to increase in the near future, so he wants to know if he is eligible for an increase or not.
Answering this question, Lawyer Nguyen Thu Trang, Deputy Director of Heva Law Company Limited, said that the Minister of Home Affairs has issued Circular No. 12/2026/TT-BNV dated May 29, 2026, guiding the implementation of adjusting the monthly allowance level for old and weak commune, ward, and town officials who have quit their jobs.
According to new regulations, from July 1, 2026, the monthly allowance level for this group of subjects will be increased by 8% on the level currently enjoyed at June 2026.
The Circular applies to old and weak commune, ward, and town officials who have quit their jobs and are receiving monthly allowances according to Decision No. 130-CP dated June 20, 1975 of the Government Council and Decision No. 111-HDBT dated October 13, 1981 of the Council of Ministers.
According to Article 2 of Decree No. 162/2026/ND-CP dated May 15, 2026 of the Government on adjusting pensions, social insurance allowances and monthly allowances, the new allowance level will be calculated as the allowance level for June 2026 plus 8%.
Notably, after adjustment, if the monthly allowance level is still lower than 3.8 million VND/person/month, it will continue to be increased.
Specifically, people with a benefit level below 3.5 million VND/month will receive an additional 300,000 VND/person/month.
For people with a benefit level from 3.5 million VND/month to under 3.8 million VND/month, it will be adjusted to 3.8 million VND/month.
As in the case of Mr. Nguyen Van Lai, who is receiving an allowance of 3.6 million VND/month, after an increase of 8%, the benefit level will exceed 3.8 million VND/month.
The Circular also clearly states that officials who were formerly Party Secretary, Chairman of the People's Committee, Deputy Secretary, Vice Chairman, Standing Committee of the Party Committee, Secretary of the People's Committee, Secretary of the Commune People's Council, Commune Military Commander, Head of Commune Police and other positions will receive a monthly allowance of 3.8 million VND from July 1, 2026.
Circular No. 12/2026/TT-BNV takes effect from July 1, 2026 and replaces the previous Circular No. 08/2024/TT-BNV.
