In order to remove obstacles in the initial stage of implementing the activity of assessing conformity for safety equipment for children used in cars (also known as children's seats - PV) according to QCVN 123:2024/BGTVT, the Ministry of Construction has just issued a document requesting the Vietnam Register to urgently organize the certification and declaration of conformity for this product.
According to the Ministry of Construction, the implementation must ensure quality management requirements, product safety, and at the same time not allowing unnecessary congestion in the process of evaluation, certification and declaration of conformity.
According to the request of the Ministry of Construction, the Vietnam Register is responsible for receiving, considering, evaluating and deciding to appoint conformity assessment organizations that fully meet the conditions according to QCVN 123:2024/BGTVT, Decree No. 37/2026/ND-CP and relevant legal regulations.
Along with that, the Vietnam Register must publicize the focal point for receiving dossiers, dossier components and dossier processing procedures; and must not set additional conditions or procedures outside regulations.
For conformity certification activities according to QCVN 123:2024/BGTVT, the Ministry of Construction assigns the Vietnam Register to proactively choose appropriate implementation plans based on its functions, tasks, powers, actual capacity conditions and legal regulations.
The certification must ensure the correct conditions, scope, order and procedures as prescribed.
A noteworthy content in this direction is the handling plan for cases where there is no testing organization to promptly meet testing needs according to regulations.
Accordingly, the Ministry of Construction authorized the Director of the Vietnam Register to decide on the temporary designation of testing organization according to the provisions of Clause 2, Article 73 of Decree No. 37/2026/ND-CP.
Within the scope of authorization, the Director of the Vietnam Register is allowed to proactively consider, decide and be responsible for temporary appointment. The maximum term for temporary appointment is 6 months from the date of signing the decision.
The Ministry of Construction also requests the Vietnam Register to send decisions and handling documents immediately after issuance for the Ministry to monitor and inspect. In the process of implementation, if difficulties and obstacles arise, the Vietnam Register must promptly report to the Ministry for consideration and direction.

Previously, regarding the implementation of conformity assessment, certification and declaration of conformity for safety equipment for children used in cars according to the National Technical Regulation QCVN 123:2024/BGTVT, in an exchange with a reporter from Lao Dong Newspaper, Mr. Nguyen To An - Deputy Director of the Vietnam Register - said that this agency has sent a report to the Ministry of Construction on the implementation situation, which clearly states that so far no certification organization is qualified to carry out certification activities according to the above regulations.
According to Mr. An, to be appointed by the Vietnam Register to carry out certification activities, first of all, conformity assessment organizations must register for operation with the local Department of Science and Technology. After being granted an operating registration certificate, the dossier will be sent to the Vietnam Register for consideration.
In case all requirements are met, the Department will appoint that unit to carry out certification activities.
Also according to the Deputy Director of the Vietnam Register, in a report sent to the Ministry of Construction, this agency has proposed a handling plan in case by July 1, 2026, there is still no testing organization, certifying sufficient operating conditions.
Accordingly, the Vietnam Register proposed to consider temporarily appointing the Motor Vehicle Testing Center (under the Vietnam Register) to conduct child safety seat testing according to QCVN 123:2024/BGTVT, and at the same time assign the Department to temporarily undertake certification work to meet the needs of the people.
Mr. Nguyen To An also said that at this time, if products labeled QCVN 123:2024/BGTVT appear on the market, this is not appropriate, because so far no organization has been registered and designated to carry out certification activities according to this standard.
According to the provisions of Decree 238/2026/ND-CP of the Government, from August 15, drivers of cars carrying children under 10 years old and under 1.35m tall without using appropriate safety equipment will be subject to a warning.
This regulation does not apply to passenger transport business cars.
