In February 2024, Mr. Tran Minh Chien - Chairman of Nha Trang City People's Committee signed a document to resolve the petition of Mr. Pham Nguyen Ha Son (residing in Cam Ranh City).
Mr. Son is the person who reported that the Nha Trang City authorities continuously caused difficulties by requiring the provision of the original land use right certificate when carrying out procedures to change land use purpose.
Mr. Pham Nguyen Ha Son said that in the process of handling procedures for changing land use purposes, there is no regulation requiring people to provide original documents.
Citizens only need to declare and provide a copy of the land use right certificate, which is enough information for the Department of Natural Resources and Environment to appraise and advise the Nha Trang City People's Committee to issue a decision to allow the change of purpose.
Finally, citizens proceed to pay financial obligations and register changes.
Up to now, the Department of Natural Resources and Environment has refused to resolve administrative procedures for Mr. Son's case because the file does not have the original, copy, or photocopy of the Land Use Rights Certificate and the information of the land plot according to the Application for change of land use purpose is not correct with the information on the cadastral map.
After inspection, Chairman of Nha Trang City People's Committee Tran Minh Chien concluded that the Department of Natural Resources and Environment's request for the above documents was not in accordance with regulations.
The City People's Committee has directed the Department of Natural Resources and Environment of Nha Trang City to rectify and learn from experience.
Nha Trang City also checked the information of the land plot recorded in the application for change of purpose of Mr. Nguyen Quang Duy and Ms. Nguyen Thi Thu Trang for land plot No. 43, map sheet No. 15, Vinh Phuoc ward (Mr. Son is authorized) is not correct information on the cadastral map.
Regarding this matter, Nha Trang City People's Committee stated that the land plot information is not consistent with the cadastral map, so the Department of Natural Resources and Environment has no basis to advise on a solution.
At the same time, Mr. Son is requested to contact the Land Registration Office - Nha Trang Branch to carry out the procedure to correct the information on changes in the land plot number recorded on the Certificate.
