The school has prepared bidding documents but has not issued a decision to establish them, assign them to organizations, individuals or hire qualified and capable consultants, violating the provisions of the Bidding Law...
During the project implementation, the school and American Progress Joint Stock Company (AIC Company, the winning bidder) signed an agreement to extend the contract but did not give a reason and did not sign an additional appendix to the contract.
The bidding documents for package No. 3 to adjust the content and volume of the project and the contractor selection plan have been approved by the Ministry of Education and Training; do not post the contractor selection results on Bidding Newspaper.
Packages 1 and 2 do not have a contract implementation guarantee and do not comply with the provisions of the Bidding Law.
According to the Inspectorate of the Ministry of Education and Training, the responsibility for the above shortcomings and violations belongs to Ho Chi Minh City University of Education.
The Inspectorate of the Ministry of Education and Training believes that the reason for the limitations, shortcomings, and violations of Ho Chi Minh City University of Education is due to the lack of timely awareness of the law and updating of legal documents of the school's leaders and advisory staff at the time of implementing the investment project.
The internal inspection and examination of the school has not been properly, regularly and effectively valued. The inspection and supervision work of functional units under the Ministry of Education and Training is not in-depth and regular.
The Inspectorate of the Ministry of Education and Training believes that the responsibility for the above limitations, shortcomings and violations belongs to the Principal and Chairman of the Council of Ho Chi Minh City University of Education ( duration of project implementation) as the head.
In addition, the Deputy Director in charge (project implementation period) is responsible for limitations, shortcomings, and violations in the role of the person assigned to be in charge.
Relevant departments, functional offices, and individuals are responsible for advising and implementing tasks that may lead to limitations, shortcomings, and violations in each field.
