The Ministry of Public Security said that the Law on Domestic Violence Prevention and Control 2022 (effective from July 1, 2023) has made important steps in protecting victims, in which the regulation on contact prohibition measures plays a key role.
Pursuant to the provisions of the Law on Prevention and Control of Domestic Violence 2022, it is necessary to develop and promulgate a Circular regulating the supervision of the implementation of the decision to prohibit contact, ensuring the effective implementation of the measure of prohibiting contact as prescribed by the Law.
Accordingly, the draft Circular includes 17 Articles and 2 forms regulating the supervision of the implementation of the decision to prohibit contact according to the provisions of the Law on Prevention and Control of Domestic Violence.
In particular, some basic contents of the draft stipulate: Assigning supervisors to implement the Decision on prohibiting contact; Developing, approving and promulgating a Plan for implementing supervision; Handling when the person under supervision violates the Decision on prohibiting contact; Ending supervision; Responsibilities of agencies, organizations and individuals coordinating the implementation of supervision...
Regarding the assignment of a person to supervise the implementation of the Decision on prohibition of contact, the draft regulation stipulates that, immediately upon receiving the decision on prohibition of contact from the Chairman of the People's Committee at the commune level, within 6 working hours and within 3 working days from the date of receiving the decision on prohibition of contact from the People's Court that is handling or resolving the civil case between the person suffering from domestic violence and the person committing domestic violence, the Commune, Ward, and Town Police (hereinafter referred to as the Commune Police) must issue a Decision on assigning a person to supervise the implementation of the decision on prohibition of contact after discussing with the Village Chief, Head of the Residential Group and relevant organizations at the grassroots level.
The decision to assign a supervisor must be based on the personal background, conditions, and circumstances of the person being supervised; based on the personal background, conditions, circumstances, capacity, and workload of the person assigned to supervise. A person can be assigned to supervise many people, but not more than 3 people at the same time.
During the supervision process, if the supervisor is not able to continue performing the assigned tasks or fails to complete the assigned tasks, the Commune Police Chief must promptly assign another person to replace him/her.
