In the process of contributing opinions to the draft revised Law on Social Insurance (BHXH), the Ministry of Finance has proposed to adjust regulations on the right to health insurance (BHYT) of social insurance benefit recipients.
Based on receiving opinions, the latest draft has been revised by the Ministry of Home Affairs in the direction of ensuring uniformity in implementation organization and in accordance with regulations on social insurance collection.
Accordingly, the Ministry of Finance contributed opinions, point b, clause 2, Article 10 on the rights of people enjoying social insurance benefits, proposing amendments in the direction that beneficiaries are entitled to health insurance in the following cases: Currently receiving pension; taking leave to enjoy monthly work accident and occupational disease allowances; during the leave period to enjoy sickness and maternity benefits from 14 working days or more in a month; currently enjoying benefits specified in Article 23 of the Law.
Compared to current regulations, the Ministry of Finance proposes to remove the regulation on the case "While on sick leave enjoying sickness benefits from 14 working days or more in a month or on sick leave enjoying sickness allowance for employees suffering from diseases on the list of diseases requiring long-term treatment issued by the Minister of Health".
At the same time, the Ministry of Finance also proposed to remove the regulation on health insurance contributions of the Social Insurance Fund for people who quit their jobs to receive sickness benefits due to diseases on the list of diseases requiring long-term treatment issued by the Minister of Health.
According to the Ministry of Finance, the amendment aims to be consistent with the principle of collecting and paying social insurance for cases of unpaid leave from 14 days or more in a month.
Regarding this comment, the Ministry of Home Affairs said that it has received and expressed it in the draft Law.
According to the latest draft, regulations on the rights of social insurance policy beneficiaries are amended in the direction of: Beneficiaries are entitled to health insurance in cases of receiving pensions; taking leave from work to receive monthly work accident and occupational disease allowances; during the leave period to enjoy sickness and maternity benefits from 14 working days or more in a month; currently enjoying benefits specified in Article 23 of the Law.
The Ministry of Home Affairs said that this draft aims to ensure uniformity in implementation and compliance with regulations on social insurance collection for cases where employees take leave to enjoy sick leave benefits for 14 working days or more in a month.
The draft amended Law stipulates in point b, clause 2, Article 10 and clause 2, Article 119 of the 2024 Law on Social Insurance in the direction: In case employees are on sick leave for 14 working days or more in a month (including employees on sick leave for sickness allowances for employees suffering from diseases on the list of diseases requiring long-term treatment), the Social Insurance Fund shall pay health insurance.
