Removing the project that has been suspended for more than 20 years
Mr. Phan Vinh Tien - Chairman of Tam Quang Commune People's Committee, Nui Thanh District, Quang Nam - said that after a series of articles reflecting on the suspended Ky Ha Port Administrative Area project in Lao Dong Newspaper, Chairman of Quang Nam Provincial People's Committee Le Van Dung directed the Management Board of Economic Zones and Industrial Parks of the province to review the planning, then propose solutions to resolve the situation of the prolonged project to ensure the lives of the people.
According to Mr. Hoang Chau Son - Deputy Head of the Management Board of Economic Zones and Industrial Parks of Quang Nam province: "If the State does not have a land use plan (in the planning area - PV), people need to be guaranteed their rights. Therefore, the Board agrees with the proposal to cancel the land recovery decision. Later, when the State implements the project, people will enjoy compensation rights according to current regulations".
The Ky Ha Port Administrative Area Project (also known as the Free Trade Zone Phase 1) had a planning decision since 2003. In January 2008, the People's Committee of Quang Nam province issued a decision to reclaim more than 262 hectares of land in two communes, Tam Quang and Tam Nghia, Nui Thanh district, to implement the project.
“It has been more than 16 years since the decision to reclaim the land was made, but the project has not been implemented, causing public outrage. In order to ensure local land management and avoid wasting land resources, Nui Thanh district requests the province to consider canceling the land reclamation decision, in order to have a basis for infrastructure investment and ensure the legitimate rights of people in the area where the land reclamation decision was made,” suggested Chairman of Nui Thanh district People’s Committee Le Van Sinh.
Strictly handle violations to limit suspended projects
For the Duy Nghia fishing village residential area project, Duy Xuyen district, with a scale of 721 hectares, approved for planning in 2008, affecting more than 1,300 households, and the Nam Hoi An Resort project, located in Duy Xuyen and Thang Binh districts, approved for planning in 2011 with a total area of 985 hectares, the progress of implementation is currently very slow, causing more than 1,500 households in the two projects to be "stuck" in dilapidated houses with inadequate and makeshift infrastructure.
According to Mr. Diep Tan Luc - Chairman of Duy Nghia Commune People's Committee, the area of unrealized fishing village planning is still quite large and has expired according to the Planning Law but has not been adjusted, canceled or there is no document mentioning whether it will be implemented or not, greatly affecting the rights of the people.
Therefore, the locality is very confused in managing and resolving land records for citizens. If this situation continues, it will reduce the reputation of the local government, and later it will be very difficult to mobilize people to implement projects.
Faced with this inadequacy, the People's Committee of Quang Nam province has decided to stop implementing 3/5 resettlement projects (serving the above 2 projects) including: Son Vien resettlement area, Duy Hai resettlement area (phase 2 and phase 3), invested by Ky Ha Chu Lai Quang Nam Company to hand over to Duy Xuyen district People's Committee to continue implementing, in order to speed up the resettlement progress for thousands of households.
Implementing the Conclusion of the Quang Nam Provincial Party Committee on resolving the current situation of "suspended" projects, the Provincial People's Committee has reviewed slow-progressing investment projects in the area with the viewpoint of "resolutely handling recovery", "doing easy things first, doing difficult things later", ensuring "compliance with legal regulations, legitimate and legal rights of investors, enterprises and related entities"... striving to handle and resolve slow-progressing projects before December 31, 2024.
Tam Ky City leaders said that the locality has reviewed and completely handled 16 detailed planning projects 1/500 for many years. Among them, there are plans that will not be completely deleted but will be adjusted and the infrastructure framework will be retained. For plans that cannot be implemented or are unfeasible, they will be canceled.
From a legal perspective, Lawyer Nguyen Thanh Tan - Quang Nam Bar Association - said that although the Land Law has provisions on planning and land use plans, localities must develop plans for 3 years, 5 years if they do not implement the planning, they must remove it, but many localities do not do a good job of reviewing planning, leading to restrictions on people's rights.
