In late August and early September, a series of inspectors and leaders of inspection centers across the country were brought to trial, causing significant impacts on vehicle inspection activities, including in the mountainous province of Hoa Binh.
On September 29, speaking with reporters, Mr. Nguyen Duc Hung - Deputy Director of the Hoa Binh 28-01S Motor Vehicle Inspection Center, the only inspection center under the Department of Transport of this province - shared that currently, the shortage of human resources is still occurring. Due to the lack of human resources, the center can only operate one inspection line.
"At least 2 more months, the center can open a second inspection line, when it recruits more inspectors and hopes that Decree 30 will be amended soon, and contracts can be signed with inspectors who are serving suspended sentences" - Mr. Hung said.
Previously, due to human resource difficulties and having to close for a long time, Hoa Binh Motor Vehicle Inspection Center 28 - 01S had to mobilize 1 inspector from Inspection Center 36 - 05D (Thach Thanh district, Thanh Hoa province) along with 1 inspector and 4 interns of the center to ensure the operation of 1 production line.
Regarding this, recently, in the 7th Session of the 15th National Assembly, Hoa Binh voters made a request to consider and provide guidance on allowing the inspection center to continue signing contracts with individuals who are subjects in cases related to inspection activities and are given suspended sentences and are not banned from practicing.
Thereby, overcoming the crisis caused by human resource shortage and solving the legitimate needs of local people and businesses.
Regarding this issue, the Ministry of Transport has the following opinion: At Point c, Clause 16, Article 1 of Decree 30/2023/ND-CP, it is stipulated that a vehicle inspector will have his/her vehicle inspector certificate revoked when "He/she is convicted by a court judgment that has come into legal effect for violating regulations related to the field of motor vehicle inspection"; at Clause 3, Article 19 of Decree 139/2018/ND-CP, it is stipulated that "A vehicle inspector whose vehicle inspector certificate is revoked will only be assessed for re-issuance of the vehicle inspector certificate after 36 months from the date of revocation.
In case of revocation according to the provisions of Clause 6, Article 18 of this Decree, it will be re-evaluated to grant a vehicle inspector certificate upon request".
Based on the above provisions, individuals who are subjects in cases related to vehicle inspection activities, when given a suspended sentence and not banned from practicing, will still have their vehicle inspection certificates revoked. Therefore, there is no basis for vehicle inspection centers to sign contracts with the above individuals to perform professional duties.
The above regulation is one of the proposed amendments to Decree 30/2023/ND-CP of the Government to remove difficulties in vehicle inspection activities in localities in the coming time.
Therefore, the Ministry of Transport coordinated with the Ministry of Justice, Ministry of Public Security, Ministry of Planning and Investment and relevant agencies to complete the draft Decree amending and supplementing a number of articles of the above Decree and submitted it to the Government for consideration and early promulgation.
