Sending a question to the Social Insurance agency, reader L.V.H asked: "I am the owner of a grocery business household, with revenue of about 500 million VND/year, paying taxes according to the declaration method (once every 6 months). Please ask, do I have to pay compulsory social insurance?
Regarding this issue, Phu Tho Provincial Social Insurance answers as follows:
The 2024 Law on Social Insurance, effective from July 1, 2025, stipulates the participation in social insurance for business households, in which point m, clause 1, Article 2 stipulates: "Business households of business households registered to participate according to the Government's regulations" are subjects to compulsory social insurance.
Clause 2, Article 3 of Decree No. 158/2025/ND-CP dated June 25, 2025 of the Government detailing and guiding the implementation of a number of articles of the Law on Social Insurance on compulsory social insurance, effective from July 1, 2025, stipulates:
The business household owner of the business household with business registration specified in point m, clause 1, Article 2 of the Law on Social Insurance, the subjects participating in compulsory social insurance include:
a) The business household owner of the business household with business registration pays tax according to the declaration method;
b) Business household owners of business households registered for business that are not subject to the provisions of point a of this clause are subject to compulsory social insurance from July 1, 2029".
Based on the above regulations, from July 1, 2025, business households of business households registered to pay taxes according to the declaration method are subjects who must participate in compulsory social insurance.
Therefore, with the information provided by reader L.V.H, readers are subject to compulsory social insurance according to the provisions of the current Law on Social Insurance.
