On June 24, the People's Committee of Krong Pac district (Dak Lak province) informed that the unit had sent a document to the Provincial People's Committee regarding compensation for 6 teachers whose labor contracts were terminated in violation of regulations.
According to the document, implementing the two court judgments on compensation for 6 teachers whose contracts were terminated at Nguyen Thi Minh Khai Secondary School and Ea Kly Secondary School, the District People's Committee has held meetings many times, requesting professional agencies to advise on implementation.
However, the implementation process has encountered difficulties and problems, so the verdict has not yet been carried out.
Accordingly, the above two judgments and the decisions to enforce the judgments determined that the People's Committee of Krong Pak district and the two schools must jointly compensate 6 teachers with more than 1.4 billion VND.
The District People's Committee found that the implementation of the two judgments was not within the scope of the State's Compensation Responsibility Law. The State Budget Law also does not have any provisions to use the district budget to enforce judgments.
On the other hand, the two judgments did not clearly define the responsibilities of each organization and individual subject to execution. This has led to difficulties in the District People's Committee in enforcing judgments.
On October 21, 2024, the District People's Committee reported and requested the District Party Committee Standing Committee to send a document to the Provincial Party Committee Standing Committee and the Provincial People's Council to allow the district to use local budget sources for implementation.
Therefore, the District People's Committee proposed that the Dak Lak Provincial People's Committee agree on the policy of using the district's 2025 budget to implement the judgments.
At the same time, the Standing Committee of the District Party Committee is requested to report and seek the direction of the Provincial Party Committee Standing Committee to direct the inspection and clarification of organizations and individuals that allowed violations and caused damage to occur in order to have a direction for handling according to the provisions of law.
Previously, Lao Dong Newspaper reported that the Dak Lak Provincial People's Court had opened an appeal hearing on the labor contract dispute of 6 teachers.
These cases required Nguyen Thi Minh Khai Secondary School, Ea Kly and the People's Committee of Krong Pac district (Dak Lak province) to jointly compensate for the illegal termination of labor contracts.
In this trial, the representative of the People's Committee of Krong Pac district submitted a request for a trial in absentia. After reviewing the details of the case, the Trial Council, Dak Lak Provincial People's Court rejected the defendant's appeal and upheld the first instance judgment.
Previously, in mid-January 2022, the People's Court of Krong Pac district opened a first-instance trial of this case.
The court accepted part of the teachers' lawsuit. Obligate the People's Committee of Krong Pac district and related schools to pay these teachers.
