On October 18, speaking with Lao Dong Newspaper, a leader of the People's Committee of Krong Pac District, Dak Lak Province informed that after the two verdicts of the Dak Lak Provincial People's Court took effect, the District People's Committee had come up with a plan to compensate 6 teachers and pay court fees.
Accordingly, on October 9, 2023, the People's Committee of Krong Pac district submitted a document to the People's Committee of Dak Lak province and the Department of Finance requesting an additional 2.1 billion VND to pay for 6 teachers according to the verdicts and court fees.
However, the Dak Lak Provincial Department of Finance determined that the teachers whose labor contracts were terminated and won the lawsuit were not eligible for compensation under the Law on State Compensation Liability.
Therefore, the Provincial People's Committee cannot allocate funds to pay, but the District People's Committee must arrange funds to execute the judgment.
Also related to this incident, at the end of 2023, the People's Committee of Krong Pac district established a working group to identify individuals who gave advice, approved policies, and signed labor contracts with the above 6 teachers.
This move was intended to require individuals involved in the incident to be held responsible for compensation. However, some of the individuals involved have passed away, so this plan cannot be implemented.
"Currently, the District People's Committee is assigning advice to specialized departments to report to the District Party Committee Standing Committee to request the policy of higher levels to use the district budget for payment. Previously, Lao Dong Newspaper reported that the People's Court of Dak Lak province opened an appeal hearing on the labor contract dispute of 6 teachers.
These cases require Nguyen Thi Minh Khai Secondary School, Ea Kly Primary School and the People's Committee of Krong Pac District (Dak Lak Province) to jointly compensate a total of more than 2.1 billion VND.
In this trial, the representative of the People's Committee of Krong Pac district submitted a request for trial in absentia. After reviewing the details of the case, the Trial Panel of the Dak Lak Provincial People's Court rejected the defendant's appeal and upheld the first instance judgment.
Previously, in mid-January 2022, the People's Court of Krong Pac district opened the first instance trial of this case.
The court accepted part of the teachers' lawsuit. It ordered the People's Committee of Krong Pac district and related schools to pay these teachers more than 2.1 billion VND.
