Checking mineral exploitation enterprises
On September 24, Lao Dong Newspaper confirmed that Bao Loc Urban Construction Joint Stock Company had just been identified by authorities, pointing out that it was exploiting beyond the licensed boundary, exploiting beyond the maximum depth of the granted license, and some other problems.
The Department of Natural Resources and Environment of Lam Dong province has requested the Company to report and clarify these contents.
The inspection results of the Department of Natural Resources and Environment of Lam Dong province showed that the above enterprise was granted a license by the Provincial People's Committee to exploit minerals and stone at the mine in village 5, Dai Lao commune, Bao Loc city.
The total licensed area of the quarry is 6.2 hectares, the mining reserve is 503,787m3, and the mining capacity is 40,000m3/year. The mining period is 12 years, and has now expired.
The inspection results determined that this Company exploited minerals outside the license boundary as recorded in the minutes dated August 8, 2024. The Company signed the confirmation.
A series of violations over many years
On August 12, 2024, the Department of Natural Resources and Environment of Lam Dong province requested the above company to report and explain a number of contents for handling according to regulations.
The authorities have inspected the company's periodic reports on mineral exploitation activities from 2005 to May 2017.
From there, comparing the amount of stone the enterprise has exploited and tax declarations (provided by the tax authority - PV) with the data in the mine closure project and mining activity reports over the years.
The Department of Natural Resources and Environment of Lam Dong province has requested the company to prepare a report and explain why there are discrepancies in exploited output and tax declaration and financial obligations to the tax authority.
In addition, the Department of Natural Resources and Environment of Lam Dong province also requested the enterprise to explain in detail the time, fees, taxes and issues related to the additional volume of stone arising when mining beyond the boundary.
In fact, this company exploited an area of 6,000m3 beyond the permitted depth boundary; exploited 275m3 beyond the licensed boundary... The amount of illegally exploited minerals is up to thousands of m3.
Lam Dong Department of Natural Resources and Environment also requested the company to clearly report the responsibilities of leaders and individuals in each year and each period of violations; the amount of illegal profits in the mineral sector due to exploitation beyond the licensed boundaries and not in accordance with the license.
To clarify related issues, the Department of Natural Resources and Environment of Lam Dong province requested the People's Committee of Bao Loc city to coordinate in inspecting and reviewing the management and use of land in an area of 6.2 hectares according to the direction of the Provincial People's Committee.
The City People's Committee must inspect the land use and land lease of households growing coffee on an area of 1.81 hectares at the Dai Lao quarry licensed to Bao Loc Urban Construction Joint Stock Company for handling according to regulations.
Previously, in early 2024, Lam Dong Provincial People's Committee fined Bao Loc Urban Construction Joint Stock Company VND 140 million for administrative violations regarding the time limit for exploiting construction stone at Dai Lao quarry, in village 5, Dai Lao commune.
Currently, due to the expiration of the mining license, the quarry has been closed since May 6, 2017. However, the Company has not yet completed the documents and procedures to request the mine closure and submitted them to the State agency as prescribed.
