Article 75 of the Law on Social Insurance stipulates the suspension, termination, and continued enjoyment of monthly pensions and social insurance allowances.
Accordingly, the law stipulates the termination of enjoying monthly pensions and social insurance allowances for people who are receiving them when falling into one of the following cases:
Died or declared dead by the court.
Refusing to receive monthly pension and social insurance allowance in writing.
The conclusion of the competent authority on enjoying social insurance is not in accordance with the provisions of law.
Regulations on temporary suspension of receiving monthly pensions and social insurance allowances for people who are receiving them when falling into one of the following cases:
Illegal exit.
Declared missing by the court.
When the beneficiary information cannot be verified according to regulations.
Monthly pensions and social insurance allowances that are temporarily suspended or terminated are allowed to continue to be paid, including monthly pensions and social insurance allowances for the time they have not been received when falling into one of the following cases:
People returning from illegal exits.
There is a decision of the Court to cancel the decision declaring missing or the decision declaring dead.
The subject specified in point c, clause 1 of this Article has verified the information as prescribed in point c, clause 2, Article 11 of this Law.
Monthly pensions and social insurance allowances of subjects subject to regulations refusing to receive pensions are continued to be paid from the time the social insurance agency receives a written request to re-receive pensions and monthly social insurance allowances and do not include monthly pensions and social insurance allowances for the period of not receiving them due to refusal to receive them.
A person receiving a pension or monthly social insurance allowance who has not received a pension or allowance before death, the relatives of that person are entitled to receive a pension or allowance for the months they have not received.
A person who is temporarily suspended from enjoying a pension or monthly social insurance allowance when there is a court decision declaring them missing, and then a court decision declaring them dead, the relatives of that person are not entitled to receive pensions or allowances during the suspension period.
Other cases of temporary suspension, termination, and continued enjoyment of pensions and monthly social insurance allowances according to the Government's regulations.
