Binh Chanh District Party Committee held a ceremony to hand over the decision to restore party membership rights to Mr. Nguyen Van Khan on August 22.
Mr. Nguyen Van Khan is allowed to participate in party activities and exercise the rights and obligations of party members according to the Party Charter and current Party regulations. Mr. Nguyen Van Khan's Party age is 40 years and 10 months calculated from the date of admission to the Party on October 30, 1983.
At the ceremony, Mr. Nguyen Van Khan said he was very touched when the Standing Committee of Binh Chanh District Party Committee awarded the decision to restore his party membership rights after 30 years of his case being cleared . He said that he will well comply with the Party's policies and guidelines, the State's legal policies and complete all assigned tasks at the cell where he lives.
More than 30 years ago, on November 12, 1991, Mr. Nguyen Van Khan, Director of Thai Duong Joint Stock Company, signed an economic contract with Mr. Dang Kien Cuong to transfer 177,800 m2 of land in Tan Tao commune, Binh Chanh district (total worth 1,019 taels of 96% gold) with the witness of the Department of Industry and Construction of Binh Chanh district.
During the contract implementation process, Mr. Cuong gave Mr. Khan 991 taels of gold to buy the above land from 25 households. Mr. Khan paid the households 800 taels of gold to buy 123,116m2, of which 22,149m2 was transferred to Mr. Cuong. The remaining 100,967m2 was undergoing transfer procedures. On October 2, 1992, the People's Committee of Binh Chanh district issued an official document not allowing Mr. Khan and Mr. Cuong to transfer the land.
On October 15, 1994, Mr. Cuong filed a complaint against Mr. Nguyen Van Khan to the Binh Chanh District Police.
Nearly a month later, Binh Chanh District Police issued a decision to prosecute and temporarily detain (approved by the People's Procuracy at the same level) Mr. Khan for fraudulent appropriation of citizen property as prescribed in Article 157 of the Ministry. Criminal Law 1985.
On April 11, 1995, the People's Procuracy of Binh Chanh district transferred the case to PC16 Division (Ho Chi Minh City Police) to handle it according to its authority - due to the large value of damaged property and the complexity of the case.
However, during the investigation and prosecution process, the Ho Chi Minh City People's Procuracy found that Mr. Khan could not continue to perform the contract because on October 2, 1992, the People's Committee of Binh Chanh district issued an official document not allowing the transfer of the area to continue. land. Furthermore, Mr. Cuong is also partly at fault according to the provisions in the contract appendix; The consequences of not performing the contract have been overcome; The dispute arising between the parties is a civil relationship... Since then, the Procuracy has not prosecuted Mr. Khan for criminal liability.
On November 25, 1995, the Ho Chi Minh City People's Procuracy canceled the temporary detention and issued a ban on Mr. Khan from leaving his residence. Two years later, this agency decided to suspend the investigation of Mr. Khan.
After 30 years of being unjustly imprisoned , on January 31, 2024, representatives of the Ho Chi Minh City People's Procuracy, Binh Chanh District People's Procuracy, and Ho Chi Minh City Police organized a public apology for Mr. Nguyen Van Khan.
