On January 8, according to information obtained by Lao Dong Newspaper, the Inspectorate of Thua Thien Hue Province (from January 1, 2025, Hue will become a centrally-run city and will be renamed Hue City Inspectorate) has just issued an inspection conclusion (KLTT) on the responsibility for performing public duties in the process of handling procedures to implement non-budgetary investment projects in the area. The inspection period is from January 1, 2023 to June 30, 2024.
According to the KLTT, in the process of performing their duties and public services, the Provincial Economic and Industrial Zone Management Board (EZMB), the Department of Natural Resources and Environment (DONRE), the Department of Construction and related agencies and organizations still have many shortcomings and violations in handling administrative procedures.
Through the inspection of the reception and return of results at the Provincial Public Administration Service Center for 20 procedures/8 areas under the responsibility and authority of the Economic Zone Management Board, the Department of Natural Resources and Environment, and the Department of Construction, it was found that there were many errors and that the procedures and regulations were not followed. Accordingly: Officials and civil servants participating in the administrative procedure (TTHC) settlement process did not fully sign and clearly state their full names, date and time of receiving and delivering the documents on the receipt and appointment form for returning results, the document settlement process control form, the apology form and the appointment to return the results as prescribed; Officials, civil servants and public employees assigned to check and update the progress of handling TTHC have not fully updated the progress of processing each file on the information system for handling TTHC of Thua Thien Hue province...
Not following the regulations properly, causing time to be extended for investors
Regarding the investment policy approval procedure of the Provincial Economic and Industrial Zone Management Board (Management Board), there were 6 dossiers/5 projects arising during the inspection period. Of which, there were 2 cases of returning dossiers and refusing to resolve, including:
Regarding the "Loc Thuy Water Plant Project", the Management Board is reviewing and updating the project into the master plan for the construction of Chan May - Lang Co Economic Zone, the land use plan until 2030 of Phu Loc district and making a list of projects calling for socialized investment. The project "110kV connection after Chan May 220kV Substation" involves many sources of capital, including state-managed capital, so the Management Board has no basis for consideration and acceptance.
The results of checking the remaining 4 files showed that 2 files were under the investment policy approval procedure, and 2 files had incorrect procedure identification.
General shortcomings and violations: Before deciding to approve the investment policy according to the prescribed authority, the Management Board prepares a report with all documents to send to the Provincial People's Committee for consideration and unanimous decision for all projects according to the provisions of Clause 5, Article 10 of the Regulations on procedures for implementation, supervision, and management of investment and construction projects not using state budget capital in the Economic Zones and Industrial Parks of Thua Thien Hue province. However, this is not in accordance with the procedures and regulations of the Investment Law 2020, Decree 31 of 2021 of the Government, Law on Promulgation of Legal Documents, etc.
The reporting and provision of documents for 5 non-budgetary investment projects located in the Economic Zone and industrial zones to serve the inspection activities of the Economic Zone Management Board were incomplete, affecting the overall results of the inspection. This responsibility belongs to the Head of the Economic Zone Management Board and related officers.
In addition, in other areas such as architectural planning, construction activities, and construction quality management at the Economic Zone Management Board, the Department of Construction still has some shortcomings and errors. The Department of Natural Resources and Environment and the Economic Zone Management Board have not properly implemented regulations in land allocation and leasing; the handling of procedures in the environmental field has not been properly implemented by the Department of Natural Resources and Environment and the Economic Zone Management Board, causing a delay for investors.
In the field of geology and minerals, the Department of Natural Resources and Environment advised the Provincial People's Committee to issue Decision No. 2506 dated October 21, 2023, shortening the time to handle administrative procedures related to licensing for mining, exploration and approval of mineral reserves. However, the process has not specified the time for each stage as instructed by the Ministry of Natural Resources and Environment, leading to the return of dossiers not in accordance with regulations. The Department of Natural Resources and Environment also established a Technical Advisory Council without authorization from the Provincial People's Committee, violating regulations. Some dossiers were processed slowly and returned results in violation of regulations. The responsibility belongs to the Director of the Department of Natural Resources and Environment, Head of the Mineral Resources Department and related officers.
In addition, the Department of Planning and Investment advised the Provincial People's Committee to approve the investment policy and investors with project operation durations that were not in accordance with regulations. The responsibility lies with the Department Director, Head of the Department of Enterprises, Collective and Private Economy, and related officials.
