To ensure the management, use and handling of houses and land at state-owned enterprises for the right purposes, effectively, in accordance with the provisions of law, avoiding loss and waste, Vice Chairman of the People's Committee of Quang Binh province Phan Phong Phu requested relevant units and localities to guide state-owned enterprises on the content of land use plans when equitizing state-owned enterprises according to regulations, review the land use plans after equitization of state-owned enterprises within the scope of the sector's functions and tasks to guide the resolution of problems and difficulties (if any) in the management and use of land of state-owned enterprises in accordance with the provisions of the law on land.
Resolutely reclaim land from state-owned enterprises that use land for purposes other than those assigned, leased, or recognized by the state for land use rights; lend or lease land not in accordance with regulations; allow land assigned to the state for management to be encroached or occupied; fail to put land into use or delay the progress of land use compared to the progress recorded in the investment project; fail to fulfill financial obligations to the state; reduce or no longer have the need to use land, and other cases as prescribed by the law on land.
Receive houses and land of state-owned enterprises whose recovery plans have been approved by competent authorities, transfer them to local management and handling according to the provisions of law; submit plans to handle houses and land of state-owned enterprises under the management of the Provincial People's Committee in accordance with regulations.
The change of land use purpose, the transfer of land use rights, the sale of assets attached to land and the exercise of other rights related to land shall comply with the provisions of the law on land and other relevant laws, ensuring publicity and transparency. The sale of fixed assets of enterprises shall be carried out through auctions in accordance with the provisions of the law on auctions, the law on land, the law on management and use of state capital invested in production and business at enterprises and other relevant laws.
Director of Quang Binh Railway Joint Stock Company Tran Ngoc Son said that recently the unit has focused on implementing activities to effectively manage and use houses and land to avoid loss and waste of state funds. Currently, the company is centrally managing the agency headquarters, auxiliary works used for maintenance, housing, warehouses, factories, along with a hotel in Dong Hoi City.
In order to avoid loss and waste for the state, the company has organized and evaluated the classification based on the needs of use for renovation, maintenance and repair every year. Each year, the company has spent more than 1 billion VND for this, in order to maximize the good use function, serving the production needs.
