Sending a question to the Social Insurance agency, reader D. T. H. N asked: I am a non-specialized commune-level official, contributing to social insurance for 1 year. New regulations on social insurance for non-specialized officials contributing to the maternity fund from July 1, 2025. Please ask, if I give birth in September 2025, will I be entitled to maternity benefits?
Vinh Long Provincial Social Insurance answers this question as follows:
Based on Clause 1, Article 50 of the 2024 Law on Social Insurance:
Subjects specified in points a, b, c, d, i, k, l, m and n, clause 1 and clause 2, Article 2 of the 2024 Law on Social Insurance are entitled to maternity benefits when falling into one of the following cases:
a) Pregnant female workers;
b) Female workers giving birth;
c) Female surrogate workers;
d) Female workers using surrogacy;
e) Employees adopting children under 06 months old;
e) Employees using contraceptive methods that must be performed at medical examination and treatment facilities;
g) Male workers participating in compulsory social insurance whose wives have children or whose wives are surrogate mothers".
Based on Clause 2, Article 50 of the 2024 Law on Social Insurance: "The subjects specified in Points b, c, d and d, Clause 1, Article 50 of the 2024 Law on Social Insurance must pay compulsory social insurance for 06 months or more in the 12 consecutive months before giving birth or receiving children when using surrogacy or adopting children under 06 months old".
Thus, based on the above regulations, if Ms. Dang Thi Huynh Nhi pays enough compulsory social insurance for 06 months or more within the 12 months immediately preceding childbirth, she will be eligible for maternity benefits according to regulations.
