Regarding the incident in which Son Hai Group complained about the removal of the words "10-year warranty commitment" on the sign on the highway section through Nghi Son town (Thanh Hoa province), on November 4, the leader of Son Hai Group said that the installation of the above words was carried out according to the contract with the investor and before installing this sign, a written request for the opinion of the Ministry of Transport (MOT) was sent.
Son Hai Group explained that on October 25, 2022, it sent a document to the Ministry of Transport requesting a 10-year warranty for the Nghi Son - Dien Chau expressway section, including the content of "publicly posting a 10-year warranty sign for people participating in traffic to be monitored".
“After receiving our document, the Ministry of Transport assigned it to the investors to sign the contract. In which, the content of the contract appendix stated: This contract appendix is the legal basis for Son Hai Group Company Limited to publicly perform the obligation to guarantee the project. Before putting it into use, we installed 9 10-year warranty signs on the implemented route” - Son Hai Group leader informed.
According to the leader of Son Hai Group, it has been more than a year since the above section was put into operation. According to the provisions of the law on construction, the construction warranty is an agreement and contract between the investor and the contractor. Signing a contract and placing a 10-year warranty sign on the construction is not against the regulations and has precedent.
“Previously, the Ministry of Transport assigned, the investor signed a contract with the contractor and we completed the 5-year warranty, so putting up a 10-year warranty sign so that people participating in traffic can be monitored cannot be called a violation of road traffic” - the leader of Son Hai Group explained.
According to Son Hai Group, the 9 10-year warranty signs were invested by the unit itself, and were outside the volume and value according to the design documents that the investor had paid to the unit. Therefore, when the handover was completed to the investor, these 9 signs were not included, so this item is not state property.
"The installation of this notice board is for people to monitor the company's warranty, not for advertising" - the leader of Son Hai Group affirmed.
Previously, as reported by Lao Dong Newspaper, Son Hai Group sent a criminal complaint to Thanh Hoa Provincial Police and Nghi Son Town Police requesting an investigation into the act of sabotage on the Nghi Son - Dien Chau expressway.
Along with the criminal complaint, Son Hai Group also sent photos and videos as evidence.
Regarding the above incident, a representative of the leadership of Road Management Area II, under the Vietnam Road Administration, confirmed that it was the unit that directed the removal of the above inscription.
The representative of Road Management Area II said that the reason for removing this line of writing was because it was not in the design documents. When the road was completed, the government had paid all related items to the contractor (including the sign item), and the above line of writing was not in the design documents, so the unit had it removed.
Speaking to Lao Dong Newspaper, a representative of Thanh Hoa Provincial Police said that after receiving the complaint from Son Hai Group, they transferred it to the investigation agency; assigned Nghi Son Town Police to handle, verify and clarify.
