On October 16, Mr. Le Trong Yen - Vice Chairman of Dak Nong Provincial People's Committee said that he had just signed and issued Decision No. 29/2024, regulating the area of agricultural land used to build works directly serving agricultural production in the area.
Applicable subjects are agricultural land plots with an area of 500m² or more.
These land plots are used by individuals and communities, and have been allocated, leased, recognized for land use rights, leased land use rights, or transferred, inherited, or donated by the State.
Accordingly, the rate of construction works on agricultural land in Dak Nong is as follows:
Land with an area of 500m² to 5,000m² can be used for construction of no more than 25m². Land with an area of 5,000m² to 10,000m² can be used for construction of no more than 50m².
Land with an area of 10,000m² to 50,000m² can be built on a construction of no more than 100m². Land with an area of 50,000m² to 300,000m² can be built on no more than 300m².
Land with an area of over 300,000m² is used to build a project of no more than 500m².
Works directly serving agricultural production are built in many locations on the land but the total area does not exceed the regulations.
Buildings that directly serve agricultural production include rest houses, sheds, and camps to serve workers. The building can also be used for preliminary processing and preservation of agricultural products, storage of agricultural materials, machinery, and tools, or for displaying and introducing agricultural products.
The land area for construction is a land area with clear boundaries, including 1 or more adjacent plots of land, used by one entity or by many entities with shared use rights.
Land users who need to build works directly serving agricultural production must send a written notice to the People's Committee of the commune where the land is located.
The Commune People's Committee is responsible for inspecting, supervising, and recording construction works according to regulations.
The decision takes effect from October 24, 2024.
