On the Ministry of Construction Information Portal, reader N.N.K reflected: "I am an individual who buys and uses yellow license plate cars, in addition to doing business to earn extra income, my main needs are travel and serving my family.
So please ask with Decree No. 336/2025/ND-CP, am I required to wear uniforms and badges when driving, in which cases do I not need badges and uniforms? Especially when carrying family and traveling every day.
I see some inadequacies in this Decree or have not been specifically guided for cases like the one I presented.
My car has been fully equipped with stamps, badges, and contract car stamps. Furthermore, this is a personal car, not a company car or issued by a cooperative, is wearing uniforms and badges appropriate?
The Vietnam Road Administration answers this question as follows:
According to the provisions of Circular No. 36/2024/TT-BGTVT dated November 15, 2024, regulating the organization and management of automobile transport activities and the operation of bus stations, parking lots, rest stops, and road stops; stipulating the order and procedures for putting bus stations and rest stops into operation, requiring the development of internal regulations on uniforms and name tags for drivers and service staff on vehicles, specifically as follows:
Types of transport business that require business units to develop internal regulations on uniforms and name tags for drivers and service staff on vehicles include: Public passenger transport business by bus (Clause 3, Article 22); passenger transport business by taxi (Clause 2, Article 27).
Types of transport business assigned to transport business units are responsible for developing internal regulations on uniforms and name tags for drivers and service staff on vehicles, including: passenger transport business on fixed routes (Clause 6, Article 14); passenger transport business under contracts (Clause 3, Article 31).
The type of business of freight transport does not stipulate the responsibility of business units to develop internal regulations on uniforms and name tags (Article 35).
Therefore, for the type of transport business that does not stipulate that drivers and service staff on the vehicle must wear uniforms and name tags, they will not be penalized according to the provisions of Clause 1, Article 11 of Decree No. 336/2025/ND-CP dated December 22, 2025.
