On the Government Portal, Ms. N.H asked that the car is under the company's name, after completing the company name change procedures, the car has a new registration and a new license plate, however, the registration period and road fees are still valid, so do I have to go for inspection and pay road fees according to the new license plate information?
The Ministry of Construction responds to this issue as follows:
Currently, the inspection of technical safety and environmental protection of automobiles is carried out according to the provisions of Circular No. 47/2024/TT-BGTVT dated November 15, 2024 of the Minister of Transport (now the Ministry of Construction) stipulating the inspection order and procedures for exemption from initial inspection for motor vehicles and specialized motorbikes; the order and procedures for certification of technical safety and environmental protection for modified motor vehicles and modified specialized motorbikes; the order and procedures for inspection of emissions of motorbikes and mopeds.
Accordingly, there is no regulation on cars having to re-inspect in cases where the car is under the company name, after completing the procedures to change the company name, a new registration or new license plate is issued, but the inspection period is still valid.
However, in case the car changes the new license plate and has a change in the license plate color, it must be re-inspected to ensure that the information on the inspection certificate is consistent with the type of transportation and inspection cycle.
According to Decree No. 90/2023/ND-CP dated December 13, 2023 of the Government regulating the collection rate, collection, payment, exemption, management and use of road use fees, the company's cars only change ownership from one organization to another, so the paid road use fee collection rate cannot be changed.
Therefore, if the car has been paid the fee according to the inspection cycle and the time to pay the road use fee is still valid, the company does not have to pay the road use fee according to the new license plate information.
However, to have information about the owner, the new license plate match the toll collection data and road toll collection stamp (attached on the car), the company should go to the inspection facility to make appropriate changes to the information.
