Abandoning traffic violation vehicles during Tet will not allow new motorbike registration

Currently, many people have a mentality of avoiding paying traffic violation fines and abandoning confiscated motorbikes. However, if people abandon their vehicles, they will not be allowed to register new vehicles.

Abandoning old motorbikes will not allow new vehicle registration

According to information from the Traffic Police Department, during the Lunar New Year, functional forces seized many violating vehicles.

Specifically on February 21 (the 5th day of Tet), traffic police and police of units and localities simultaneously launched a campaign to handle the topic of alcohol concentration on traffic routes during a certain time frame according to the direction of the Director of the Traffic Police Department.

Traffic police forces of 34/34 localities continue to simultaneously control alcohol concentration for drivers participating in traffic from 10:00 AM to 2:00 PM on February 21, 2026 (5th day of Binh Ngo Tet).

As a result, the Traffic Police force controlled 32, 299 vehicle trips (1,397 passenger cars, 1,251 trucks, 8,250 cars, 20,664 motorbikes, 737 rudimentary vehicles and other vehicles); detected and made records of handling 724 cases of alcohol concentration violations (10 cars, 691 motorbikes, 6 specialized vehicles, 17 rudimentary vehicles and other vehicles).

According to regulations, cases of alcohol concentration violations will have vehicles temporarily seized.

In fact, many people have the mentality of abandoning violating vehicles, especially low-value motorbikes, to evade paying fines. However, abandoning vehicles will face many legal troubles.

Lawyer Nguyen Thu Trang, Deputy Director of Heva Law Company Limited, said that if the person violating alcohol concentration abandons the vehicle and does not comply with paying the fine, they will not be allowed to register a new vehicle.

Circular 24/2023/TT-BCA regulating the issuance and revocation of registrations and license plates for motor vehicles, amended and supplemented in Circular No. 51/2025/TT-BCA of the Ministry of Public Security, clearly states:

Organizations and individuals who violate traffic order and safety but do not comply with the decision to sanction administrative violations in the field of traffic will not be granted vehicle registration; after complying with the decision to sanction administrative violations in the field of traffic, they are allowed to register vehicles according to the provisions of this Circular.

Therefore, when being penalized for alcohol concentration violations and the vehicle operator has not paid the fine, a new vehicle will not be registered.

Levels of penalty for alcohol concentration and deduction of points for driver's licenses for motorbike drivers

According to Article 7 of Decree 168/2024/ND-CP, the penalty level and deduction points for drivers of motorbikes, mopeds and similar types of vehicles are specified as follows:

A fine of between VND 2,000,000 and VND 3,000,000 shall be imposed on drivers of vehicles on the road who have alcohol concentration in their blood or breath but not exceeding 50 milligrams/100 milliliters of blood or not exceeding 0.25 milligrams/1 liter of breath; deducting 4 points from the driver's license.

A fine of between 6,000 VND and 8,000 VND shall be imposed on drivers of vehicles on the road whose blood or breath alcohol concentration exceeds 50 milligrams to 80 milligrams/100 milliliters of blood or exceeds 0.25 milligrams to 0.4 milligrams/1 liter of breath; deduct 10 points from the driver's license.

A fine of between 8,000 VND and 10,000 VND shall be imposed on drivers of vehicles on the road who have an alcohol concentration in their blood or breath exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath; revocation of the driver's license for 22 to 24 months.

A fine of between 6,000 VND and 8,000 VND shall be imposed on drivers of cars on the road who have alcohol concentration in their blood or breath but not exceeding 50 milligrams/100 milliliters of blood or not exceeding 0.25 milligrams/1 liter of breath; deducting 4 points from the driver's license.

Levels of penalty for alcohol concentration and deduction of points from driver's licenses for car drivers

Based on Article 6 of Decree 168/2024/ND-CP, the penalty level and deduction points for drivers of cars and similar types of vehicles are specified as follows:

A fine of between 6,000 VND and 8,000 VND shall be imposed on drivers on the road who have alcohol concentration in their blood or breath but not exceeding 50 milligrams/100 milliliters of blood or not exceeding 0.25 milligrams/1 liter of breath; deducting 4 points from the driver's license.

A fine of between VND 18,000,000 and VND 20,000,000 shall be imposed on drivers of vehicles on the road whose blood or breath alcohol concentration exceeds 50 milligrams to 80 milligrams/100 milliliters of blood or exceeds 0.25 milligrams to 0.4 milligrams/1 liter of breath; deducting 10 points from the driver's license.

A fine of between 30,000 VND and 40,000 VND shall be imposed on drivers of vehicles on the road who have an alcohol concentration in their blood or breath exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath; revocation of the driver's license from 22 months to 24 months.
