Decree 168/2024/ND-CP on penalties and deduction of driving license points for motorcyclists who violate regulations on vehicle conditions when participating in traffic takes effect from January 1, 2025 (Decree 168/2024/ND-CP).
Article 42 168/2024/ND-CP stipulates the sanctioning authority of the chairmen of the People's Committees at all levels as follows:
The commune chairman has the right to:
Warning penalty.
Fine up to 5,000,000 VND.
Confiscation of exhibits and means used to commit administrative violations with a value not exceeding VND 10,000,000.
Apply remedial measures prescribed in Points a and b, Clause 3, Article 3 of this Decree.
The Chairman of the District People's Committee has the right to:
Warning penalty.
Fine up to 37,500,000 VND.
Revoke the right to use a license or practice certificate for a limited period of time or suspend operations for a limited period of time.
Confiscation of exhibits and means used to commit administrative violations.
Apply remedial measures prescribed in Clause 3, Article 3 (except Point c, Clause 3, Article 3) of this Decree.
The Chairman of the Provincial People's Committee has the right to:
Warning penalty.
Fine up to 75,000,000 VND.
Revoke the right to use a license or practice certificate for a limited period of time or suspend operations for a limited period of time.
Confiscation of exhibits and means used to commit administrative violations.
Apply remedial measures prescribed in Clause 3, Article 3 of this Decree.
Clause 3, Article 3 of Decree 168 stipulates measures to remedy consequences of administrative violations of traffic order and safety in the field of road traffic, including:
a) Forced restoration of the original state that was changed due to administrative violations, except for remedial measures prescribed in Point e, Point n, Point p of this Clause.
b) Force the implementation of measures to remedy environmental pollution caused by administrative violations.
c) Forced re-export of vehicles from Vietnam.
d) Forced to return illegal profits obtained from administrative violations.
d) Forced demolition of objects obstructing road signs and traffic lights.
e) Compulsory installation of complete equipment or replacement of equipment that meets technical safety standards or restores technical features of vehicles and equipment according to regulations or removes additional equipment installed in violation of regulations.
g) Compulsory issuance of driver identification cards to drivers according to regulations.
h) Compulsory organization of training, professional guidance, procedures or organization of periodic health check-ups for drivers and service staff on vehicles according to regulations.
i) Compulsory installation of journey monitoring devices, driver image recording devices, seat belts, seats for preschool children, primary school students, specialized tools and equipment for rescue and rescue support on vehicles in accordance with regulations.
k) Forced removal of sound and lighting equipment installed on vehicles that cause disorder and disrupt road traffic safety.
l) Compulsory provision, updating, transmission, storage, and management of information and data from journey monitoring devices and driver image recording devices installed on cars according to regulations.
m) Forced adjustment of the odometer reading of the car that has been distorted.
n) Forced restoration of the brand and paint color recorded in the vehicle registration certificate according to regulations.
o) Comply with regulations on vehicle license plates, regulations on painting or pasting letters, license plate numbers, information on vehicle walls and doors, regulations on paint colors, signs and identification marks of vehicles.
p) Force the vehicle to be restored to its original shape, size, and technical safety condition and re-inspected before putting the vehicle into traffic.
q) Compulsory adjustment of vehicle body according to current regulations, re-inspection and readjustment of permitted cargo volume recorded in the certificate of technical safety inspection and environmental protection according to current regulations before putting the vehicle into traffic.
r) Compulsory procedures for changing, revoking, re-issuing, and issuing vehicle registration certificates, license plates, and technical safety and environmental protection inspection certificates according to regulations;
s) Forced to return licenses and practice certificates that have been erased or altered to distort the content.
t) Force vehicles to return to Special Economic Zones and International Border Gate Economic Zones.
