In October 2025, the Ministry of Construction submitted a draft Decree amending and supplementing a number of articles of Decree No. 160/2024/ND-CP dated December 18, 2024 of the Government regulating driver training and testing activities.
Article 12 of the draft amends and supplements the procedures for granting testing licenses to type 1 and type 2 driving testing centers as follows:
After completing the construction of a driving test center, organizations and individuals must submit construction documents and documents requesting a test license according to the form prescribed in Appendix XVII attached to this Decree to the Traffic Police Department in one of the following forms: via postal service, electronic documents.
The construction documents include: Investment policy decisions of competent authorities for domestic investors, foreign-invested economic institutions (with foreign investors holding less than 51% of charter capital) except for projects that do not require approval of investment policies or investment registration certificates for foreign investors, economic organizations with foreign investment capital (with foreign investors holding 51% or more of charter capital) (copy with the original or certified copy or electronic copy certified from the original or electronic copy from the original); overall site clearance drawings; construction permits (copy with the original or certified copy or electronic copy certified from the original or electronic copy from the original book); design documents, vehicle registration formats, electronic declarations, automatic vehicle registration formats for self-classification.
Within no more than 03 working days from the date of receipt of the request, the Traffic Police Department shall organize an inspection, make a record according to the form prescribed in the Appendix to this Decree and issue a driving license to the driving test center. In case of not granting, a written response must be given stating the reason.
The return of results is made via the postal service; in case of issuing an electronic test license, the Traffic Police Department will post it on the Electronic Information Page for the driving test center to print or store on electronic devices".
Article 13 of the draft on amending and supplementing the procedures for granting licenses to type 3 driving test centers is as follows:
After completing the construction of a driving test center, organizations and individuals must send a document requesting a test license according to Form No. 01 prescribed in Appendix XVI attached to this Decree, along with 01 set of documents via postal service or electronic documents to the Provincial or Municipal Police requesting a test license; the documents include:
Construction permit (copy with the original for comparison or a certified copy or an electronic copy certified from the original or an electronic copy from the original book).
drawings of the overall layout, design documents of the test size, and types of motor vehicles used for testing.
Within no more than 02 working days from the date of receipt of the dossier, the Provincial or Municipal Police shall check the completeness of the dossier; in case the dossier is not complete, the Provincial or Municipal Police shall have a document guiding the organization or individual to complete it according to regulations; within no more than 03 working days from the date of receipt of the complete dossier as prescribed, organize an inspection, make a record according to the form prescribed in Appendix XVII attached to this Decree and issue a testing license; in case of failure to issue, must respond in writing and state the reason. Within 05 working days from the date of granting the testing license, the provincial and municipal police must report to the Traffic Police Department in writing for monitoring and management;
