According to the Customs Department, the unit has received Official Letter No. 5880/DKVN-VAQ from the Vietnam Register (VNA) on coordination in the work of checking the quality of imported used specialized motorbikes at the border gate.
Many warning signs of violations were detected
The Vietnam Road Administration said that in the past, through management and quality certification activities for imported specialized motorbikes, the unit has discovered a number of phenomena with signs of violating the law that need to be warned and prevented.
Accordingly, after being temporarily released by the customs authority, some importing enterprises were late in presenting specialized motorbikes for the Vietnam General Confederation of Labor to conduct on-site inspections, leading to a prolonged time for quality certification. The main reason was determined to be that the enterprise took advantage of the temporary clearance to bring the vehicle back for renovation and repair, not keeping the vehicle in its original state according to regulations.
Notably, there are cases where when the Vietnam Road Administration conducts a physical inspection of used specialized motorbikes at ports and border gates at the request of the competent authority, the results do not meet the requirements according to the law, mainly used tractors.
Increased suspicions of fraud in chassis and engine numbers
According to the reflection of the Vietnam Road Administration, recently the number of specialized motorbikes with signs of being deleted, damaged, or having their chassis and engine numbers re-closed has increased, forcing them to request appraisal at specialized appraisal agencies. In particular, this situation is common for used chain cake excavators imported from China.
The above cases all showed signs of fraud in information related to the year of manufacture, the manufacturing water or the vehicle had an unclear origin (suspected the vehicle was stolen), so the subject had deleted, edited, and re-packaged the chassis number and engine number to deceive the authorities of both the export and importing country.
Preliminary statistics show that from the beginning of 2025 to now, 249 specialized motorbikes have had to be submitted for appraisal at the Institute of Criminal Science, Ministry of Public Security; of which many businesses with 2 or more vehicles have to be submitted for appraisal.
Based on current legal regulations and the opinions of the Vietnam Road Administration, the Customs Department directs the regional Customs Branches to guide customs units to coordinate with the Vietnam Road Administration to conduct state inspections on the quality of technical safety and environmental protection for imported specialized motorbikes in cases where the Inspection Registration (confirmed by the inspection agency) clearly states the inspection location at the border gate or the area under customs supervision, according to the provisions of Article 33 of Decree 08/2015/ND-CP (amended and supplemented in Clause 17, Article 1 of Decree 167/2025/ND-CP).
The Customs Department noted that the customs authority only decides to allow enterprises to bring goods to storage at locations outside the border gate and customs supervision areas to wait for the results of quality inspection after the conclusion of the inspection agency recorded in the " Minutes of recording inspection results".
The Customs Department requested border authorities at and outside border gates to strengthen inspection and control measures for used machinery, equipment, and specialized motorbikes imported from China.
In case of detecting goods that may not be of good quality or do not meet import requirements, the specialized inspection agency is requested to conduct an inspection immediately at the border gate and coordinate supervision according to the provisions of Article 33 of Decree 08/2015/ND-CP (amended and supplemented in Clause 17, Article 1 of Decree 167/2025/ND-CP).
For shipments that have passed the storage period but the enterprise has not yet submitted the results of the specialized inspection, the Customs Department directs the customs place of import to strengthen inspection, verification and handling according to the provisions of Article 32 of Circular 38/2015/TT-BTC (amended and supplemented in Circular 39/2018/TT-BTC) and related directives of the Customs Department.
