The defendants include Bui Duc Binh (born in 1973, residing in Nghia Xa ward, Le Chan district, Hai Phong) prosecuted for murder and property destruction; Nguyen Dinh Vong (born in 1990, residing in Gia Loc district, Hai Duong province, current residence at Vinh Niem Bus Station, Hai Phong city); Hoang Viet Tien (born in 1985, residing in Thieu Hoa district, Thanh Hoa), Dao Viet Tiep (born in 1992, from Thai Thuy, Thai Binh, current residence in Hai Son ward, Do Son, Hai Phong), Nguyen Trieu Hai (born in 1974, residing in An Dong ward, An Duong district, Hai Phong), Ha Manh Trang (born in 1983, residing in Hoa Binh commune, Vi Bao, Hai Phong, Nguyen Nguyen Phuong, Cao Nguyen Tien (born in 1989, residing in Hai Phong commune, Hai Phong commune, Hai Phong commune) and Nguyen Thang Minh (born in 1986, residing in Hai Phong, Hai Phong commune, Hai Phong commune) and Nguyen Thang Thang Thang (born in the year of the year of the year of the year of the year of the year of the year of the year.
At the trial, all 8 defendants were present, the victim, Mr. N.T.A (born in 1977, residing in Kien An district, Hai Phong, submitted an application for absence.
According to the indictment, around 2006, Bui Duc Binh and Mr. N.T.A (born in 1977, residing in Kien An district, Hai Phong, working together at T.L Transport Company Limited). After that, Binh contributed more shares to D.X Transport Company Limited, while Mr. N.T.A separated to do it separately, causing many conflicts. Binh thought that N.T.A often spoke ill of him, so he had the idea of beating Mr. T.A.
From around 5pm to 9:30pm on October 17, 2024, due to a small conflict, Bui Duc Binh invited the defendants: Nguyen Dinh Vong, Hoang Viet Tien, Dao Viet Tiep, Ha Manh Trang, Nguyen Cao Cuong, Ha Minh Cong, Nguyen Ba Chung, Do The Tung, Nguyen Hai Trieu to drive a 16-seat car and 3 motorbikes carrying 2 lead bullet hunting guns and 2 hook knives, into a tennis racket pocket concentrated at the gate of Vinh Niem bus station (Bui Vien street, Vinh Niem ward, Le Chan district, Hai Phong) to find and beat Mr. N.T.A.
At around 9:30 p.m., when he saw Mr. T.A driving a Kia Seltos car in Vinh Niem bus station out of the gate, Binh took a gun and headed towards Mr. T.A. Vong, Vong drove a motorbike waiting for Binh, the rest of the group drove a 16-seat car and a motorbike to the Vo Nguyen Giap - Bui Vien roundabout area to wait for Binh and Vong. When Mr. T.A's car was about 3 meters from Binh, Binh raised the gun and fired twice at Mr. T.A's head but missed it and broke the front passenger seat window, causing a loss of 3,787,000 VND.
Mr. T.A drove away while Bui Duc Binh got on Vong's motorbike and the group fled the scene. Using guns at close range, firing consecutive shots at Mr. T.A's head, although he did not hit him and Mr. T.A did not die, was unintentional for Bui Duc Binh. The defendants Nguyen Dinh Vong, Hoang Viet Tien, Dao Viet Tiep, Ha Manh Trang, Nguyen Cao Cuong, Ha Minh Cong, Nguyen Ba Chung, Do The Tung, Nguyen Hai Trieu were not discussed by Bui Duc Binh, and agreed to use guns to shoot Mr. T.A, with no fatal consequences.
However, the act of participating with Bui Duc Binh in carrying weapons and gathering in front of Vinh Niem bus station to beat Mr. T.A caused chaos, negatively affecting social order and safety.
At the trial, all 8 defendants admitted to their crimes. Based on the request of the representative of the City People's Procuracy, the Trial Council sentenced defendant Bui Duc Binh to 12 years in prison for murder and 6 months in prison for property destruction. The total sentence for defendant Bui Duc Binh is 12 years and 6 months in prison.
The remaining 7 defendants sentenced for disturbing public order include: Nguyen Dinh Vong received 4 years in prison; Hoang Viet Tien received 4 years in prison; Dao Viet Tien received 36 months in prison. In addition, Nguyen Hai Trieu was sentenced to 30 months in prison; Ha Manh Trang and Nguyen Cao Cuong were both sentenced to 42 months in prison; Ha Minh Cong was sentenced to 36 months in prison. The total sentence for these 7 defendants is 282 months in prison.
