New regulations on the order and method of implementing procedures for correcting errors in the first issued Certificate (red book) from July 1, 2025.

How are the procedures for correcting errors in the first issued Certificate from July 1, 2025?

Pursuant to sub-section 2, Section C, Part II of Administrative procedures issued with Decision 2304/QD-BNNMT in 2025, stipulating the order and method of implementing procedures to correct the first-issued Certificate (red book) with the following errors:

(1) Implementation procedures

- Step 1: The person requesting the correction submits the dossier to the Public Administration Service Center. When submitting the prescribed documents, the registration fee is selected to submit a copy of the document and present the original for the officer receiving the application to check the comparison or submit the original of the document or submit a notarized or certified copy of the document according to the provisions of the law on notarization and certification; in case of submitting the application online, the submitted dossier must be digitized from the original or the certified and certified copy of the document according to the provisions of law.

In case of submitting a copy or digital copy of all documents, when receiving the results of handling administrative procedures, the registered candidate must submit the original documents in the dossier components according to regulations.

- Step 2: The dossier receiving agency implements:

+ Check the completeness of the dossier and issue a dossier receipt and schedule a return of results.

In case the documents are not complete, the documents must be returned with the Supplement and Complete Application Form so that the applicant can register to complete and supplement according to regulations.

+ Transfer the dossier to the competent land management agency at the commune level.

- Step 3: The competent land management agency at the commune level shall:

+ Notify the Land Registration Office, the Land Registration Office Branch to transfer the dossier for the issuance of the First Certificate to check the dossier, make a record of the conclusion on the content and cause of errors.

+ Submit to the Chairman of the People's Committee at the commune level to confirm the correction on the issued Certificate or the newly issued Certificate of land use rights and ownership of assets attached to land.

+ Transfer the Certificate to the dossier receiving agency to give to the granted person.

+ Transfer the file to the Land Registration Office, Branch of the Land Registration Office to edit and update changes in land records, land database.

(2) How to do

- Submit directly to the Public Administration Service Center.

- Pay via postal service.

- Submit online on the Public Service Portal.

What documents are in the file for the procedure to correct the first-issued Certificate with errors?

Pursuant to Section 3, Sub-section 2, Section C, Part II of Administrative procedures issued with Decision 2304/QD-BNNMT in 2025, the dossier for procedures to correct the first-time issuance of a Certificate has the following errors:

- Application for registration of changes in land and assets attached to land according to Form No. 18 issued with Decree 151/2025/ND-CP.

- Original Certificate of Land Use Rights.

- Documents proving that the information of the person granted the Certificate is incorrect compared to the information at the time of request for correction or that the information about the land plot or assets attached to the land is incorrect compared to the information on the issued Certificate.

- Documents on authorization according to the provisions of civil law in cases of procedures performed through a representative.

Note: Decision 2304/QD-BNNMT in 2025 takes effect from July 1, 2025.
